HomeMy WebLinkAbout2015-06-08 15-209 ORDERCOUNCIL ACTION Item No.15-209 AS AMENDED Date: June 8, 2015 Item/Subject: ORDER, Declaring a Structure at 44 Patten Street to be a Dangerous Building and Authorizing its Demolition (Tax Map 035-14) Responsible Department: Code Commentary: In July of 2013, a fire caused extensive damage to house structure located at 44 Patten Street, which gave the City cause to condemn and placard the building. In September of 2014, the City gave the owners and all interested parties (including several lenders) 120 days to correct the deficiencies, in accordance with City ordinance. At this time, no effort has been made to correct the deficiencies and recent attempts to reach the owners have been unsuccessful. Pursuant to 17 M.R.S. § 2851 etseq. the City Council can, after notice and hearing, order the demolition of the structure which has been declared dangerous. Building Code Staff has determined that the building at 44 Patten Street is dangerous and the structure is compromised. In accordance with State law and based upon these findings, staff recommends the Council declare this building "dangerous," order the demolition of the building, and place a lien on the property to try to recoup costs. This item was reviewed and recommended for approval by the Business & Economic Development Committee at its June 2, 2015 meeting. Wolf n/k/a/ Twila A. Bulter and Charlton A. Butler, both of Bangor, Maine (hereinafter the "Owners"); and WHEREAS, other potential parties -in -interest include TD Bank, N.A., of Portland, Maine, LVNV Funding, LLC, of Greenville, South Carolina, and the Maine State Housing Authority, of Augusta, Maine (hereinafter the "Parties-in-Interest'l; WHEREAS, the Owners and Parties -in -Interest were served with notice that the Bangor City Council intended to hold a public hearing to consider whether or not the Premises constitutes a dangerous building and a nuisance under 17 M.R.S.A. §2851 et seq.; and WHEREAS, the Bangor City Council, acting in its capacity as the Municipal Officers of the City of Bangor, held a public hearing pursuant to 17 M.R.S.A. §2851 et seq. to determine whether or not the Premises constitutes a dangerous building within the meaning of said statute; BE IT ORDERED BY THE CITY COUNCIL OF THE CITY OF BANGOR, THAT based upon the evidence presented at said public hearing, the City Council of the City of Bangor hereby finds: 1. The Premises are structurally unsafe; unstable; a fire hazard; unsuitable or improper for the use or the occupancy as a residence; a hazard to health or safety because of inadequate maintenance, dilapidation, obsolescence or abandonment; and dangerous to the life and property of the inhabitants of the City of Bangor; and 2. The Premises constitute a dangerous building and a nuisance within the meaning of 17 M.R.S.A. §2851 et seq. 15-204 AS AMENDED JUNE 8, 2015 BE IT FURTHER ORDERED THAT 1. The Owners shall remedy the conditions cited above that render the premises dangerous and a nuisance within thirty (30) days by: B. Demolishing the structure and properly disposing of all debris in conformity with the Code of the City of Bangor. 2. In the event that the Owners fail to obtain a certificate of occupancy or demolish the structure and properly dispose of all debris as required above: A. The Code Enforcement Officer, or his designee, may remove and dispose of any personal property remaining in the structure; B. The Code Enforcement Officer, or his designee, shall cause said structure to be demolished or removed, all expenses incurred thereby to be paid by the Owners or assessed against the property in accordance with 17 M.R.S.A. §2853; and C. The City Solicitor, or his designee, is authorized to take any and all additional necessary action to secure the demolition or removal of said structure and recover the City's costs as provided in 17 M.R.S.A. §2853. 3. The City Solicitor, or his designee, shall cause a copy of this Order to be filed at the Penobscot County Registry of Deeds. 4. The Order may be appealed to the Superior Court pursuant to the provisions of the Maine Rules of Civil Procedure, Rule 80B. , B. In September of 2014, the City gave the owners and all interested parties (including several lenders) 120 days to correct the deficiencies, in accordance with City ordinance. At this time, no effort has been made to correct the deficiencies and recent attempts to reach the owners have been unsuccessful. Pursuant to 17 M.R.S. § 2851 etseq. the City Council can, after notice and hearing, order the demolition of the structure which has been declared dangerous. Building Code Staff has determined that the building at 44 Patten Street is dangerous and the structure is compromised. Code Enforcement Divisi Date: June 14, 2015 Re: 44 Patten Street The Code Enforcement Division recommends that the building at 44 Patten be determined to be a dangerous building and be demolished. As, Code Enforcement Officer, I have determined that the building is unsafe, unstable, structurally unsound and constitutes a hazard to health or safety because of inadequate maintenance, dilapidation, obsolescence and, or abandonment, primarily as a result of the fire that severely damaged the building in July of 2013. Below is a summary of.ongoing issues and notices that have been either investigated by or issued by the Code Enforcement Division. Additionally, I have attached copies of the notices of violation, corrective action orders and legal notices that had been sent to the owner of the property and to the other parties of interest. I will add that no work has been done on the building to either rehabilitate or secure the building from the.elements, and that the building has remained open to the weather for nearly two years. On January 14th 2013 the Code Enforcement Division placarded the above-mentioned property and determined that it was unsafe and unfit for habitation due to a lack of heat and the use of an unsafe heating system. This placarding came immediately following an incident where the use of an unpermitted and uninspected homemade coal furnace caused the carbon monoxide poisoning of the buildings occupants. It was determined that the operation of the coal stove constituted not only danger to the occupants because of the presence of toxic fumes, or gases due to the operation of dangerous equipment, but also an imminent fire hazard as well. This determination led to the issuance of the placarding notice of the building and an order to abate the ordinance violations prior to re -occupancy. This notice gave the owner thirty (30) days to correct the ordinance violations. Rights to appeal the orders were also provided to the owner at that time. No appeals were filed. On February 28, 2013, 1 sent the owners a follow up letter reminding them of the issues that led to the placarding of building and what actions needed to be taken by them in order for them to safely move back into their home. This letter was met with no response. In June of 2013, the Code Enforcement Office responding to neighborhood concerns regarding the condition of the property, and the accumulation of debris, trash, and waste and use of extension cords to power a camper trailer parked in the back yard, issued another notice of violation and order to abate the violations. Rights to appeal were provided to the owner along with the notice and order. No appeals were filed. Then on the evening of July 29, 2013 a fire destroyed the house. The Maine State Fire Marshal's Office investigated the fire. Accounts from a neighbor to the BDN the next day indicated that "there were flames were 15, 20 feet high coming out from the front of the house and the side of the house almost hitting the other building next door. Asst. Fire Chief Anthony Riitano was quoted in the BDN that "there was so much fire it got into the walls and ceilings and between the floors." The damage to the house was extensive, gutting the house. The property was mired in the foreclosure process before the fire and no corrective action has been taken by any party to address the notices of violations and orders to abate. In addition no appeals were filed appealing the City's notices. The property has sat vacant, abandoned, unsecure, and dilapidated since the incident involving the homemade coal stove and the ensuing fire in July of 2013. After a year of no progress by any party to either rehabilitate or demolish the building, the city deemed the property unfit for habitation, again, due to the structural damage caused by the fire and the disrepair of the building. The building was placarded, and the Code Enforcement Division issued another notice and order for corrective actions, including an order to rehabilitate or to demolish. The September 26, 2014 notice provided notice to all parties of interest, and the same notices were posted on the building. The September 26, 2014 notice ordered the following: 1.) That the structure may not be occupied, and if it is to be vacated immediately; 2.) That the building must be closed up and secured by October 10, 2014; 3.) That with 120 days of receipt of notice the building must either be rehabilitated to make it fit for habitation, or the structure must be demolished. 4.) And to within 120 days allow for an inspection of the property. In addition to being posted on the building this notice was provided via registered mail on September 28, 2014 to the following interested parties: 1.)
