HomeMy WebLinkAbout2009-09-14 09-298 ORDERCOUNCIL ACTION Item No_el q I - Cl Date: September 14, 2009 Item/Subject: Order, Authorizing the City Manager to Execute an Agreement with Christina and Jeff Murdyy Regarding the Sale of Malt Liquor on the Golf Course Responsible Department: Legal Commentary: Christina and Jeff Murdy are the concessionaires at Bangor Municipal Golf Course. Currently, they provide sales of malt liquor and other products from a mobile service bar as allowed by State law. The law requires that those selling malt liquor be employees of the golf course. That is currently not the situation. This Order authorizes the execution of an Agreement to have the City hire those currently employed by the Murdys to sell the malt liquor, for the Murdys to pay all costs incurred by the City and to realize the profits from sales from the mobile service bar, and to work towards a change in State law to allow the concessionaire at a municipal golf course to sell malt liquor from a mobile service cart. ORDER, Authorizing the City Manager to Execute an Agreement with Christina and Jeff Murdy Regarding the Sale of Malt Liquor on the Golf Course By ffie City Council of the City ofBangor. ORDERED, THAT the City Manager is hereby authorized, on behalf of the City of Bangor, to execute an Agreement with Christina and Jeff Murdy, concessionaires at the Bangor Municipal Golf Course, to provide for the sale of malt liquor at a mobile service bar at the Bangor Municipal Golf Course. Said Agreement shall Include the following: the Murdays shall select the employees for the sale of malt liquor subject to approval by the Director of the Parks and Recreation Department; the Murdys shall pay to the City of Bangor all costs associated with the sales from the mobile service bar; the Murdays shall realize the profits of all sales from the mobile service bar; the patties shall work towards a change in State law to allow the concessionaire at a municipal golf course to sell malt liquor from a mobile service cart.
