HomeMy WebLinkAbout2009-05-11 09-160 ORDERCOUNCIL ACTION Item No. 09 160 Date: May 11, '2009 Item/Subject: ORDER, Authorizing Development Agreement with Bangor Gas for Sale and Development of a Portion of Lot 14 in the Maine Business Enterprise Park Responsible Department: Community and Economic Development Commentary: Bangor Gas wishes to purchase approximately 2.44 acres of Lot 14 in the Maine Business Enterprise Park to develop a Bangor Gas service center. The proposal would consolidate Bangor Gas operations into an approximate 10,000 square foot building. This Order would authorize a Development Agreement with Bangor Gas whereby the City would sell approximately 2.44 acres of Lot 14 to Bangor Gas for $219,000; Bangor Gas would construct a building of at least 10,000 sq. ft.; all building and site improvements, including parking, screening, and vehicular access plans would require the approval of the Business and Economic Development Committee; Bangor Gas must commence construction in 2009 and complete construction by March 30, 2011; the property would be subject to property taxes, and the deed would require Bangor Gas and successors in ownership to waive any right of exemption from municipal taxation; allowed uses of the site would be restricted to those listed in the Council Order; and the City would be responsible for any required amendment to Maine Business Enterprise Park Subdivision Plan and Site Location of Development Act (SLODA) permit. ORDER, Authorizing Development Agreement with Bangor Gas for Sale and Development of a Portion of Lot 14 in the Maine Business Enterprise Park WHEREAS, Bangor Gas wishes to purchase 2.44 acres of Lot 14 in the Maine Business Enterprise Park to consolidate its operations by developing a Bangor Gas service center on the site; NOW, THEREFORE, BE IT ORDERED BY THE CITY COUNCIL OF THE CITY OF BANGOR THAT The City Manager is hereby authorized, on behalf of the City of Bangor, to execute a Contract For Sale of Real Estate and any other related documents with Bangor Gas for 2.44 acres in the Maine Business Enterprise Park in a form approved by the City Solicitor or Assistant City Solicitor and containing the following terms and conditions: 1) The selling price will be $219,600. 2) Bangor Gas will construct a building with a gross floor area of at least 10,000 sq. ft. 3) Plans for the building and site improvements, including parking, screening, and vehicular access, will require the approval of the Buisness and Economic Development Committee. 4) Bangor Gas shall have reviewed and be satisfied with all zoning, land use and environmental laws, codes, ordinances, and regulations affecting the property. 5) Prior to the closing, Bangor Gas shall obtain all zoning, subdivision, and environmental permits and approvals and any other applicable permit or approval as may be necessary for their proposed use and development of the property. 6) Bangor Gas will develop and occupy the premises in compliance with municipal, state, and federal laws or regulations. 7) Site work and building improvements shall commence prior to December 31, 2009. 8) Site work and building improvements shall be completed by March 30, 2011. 9) The property will be subject to property taxes, and Bangor Gas and successors waive the right of exemption from municipal taxation. 10)The property will be limited to the following uses and limitations and the deed will reflect such limitations: (a) Radio and television facilities. (b) Information processing and communications facilities. (c) Research and testing facilities of a laboratory nature. (d) Administrative offices of manufacturing, retail, banking, public utility, service or research corporations. (e) Service business limited to office use. (f) Group day-care or nursery school. (g) Day-care center. (h) Clinic, medical or dental. (m)No auto repair shops shall be permitted 11) The City will amend the Maine Business Enterprise Park Subdivision Plan. 12)The City will amend the Site Location of Development Act (SLODA) permit. 13) Bangor Gas shall not remove any trees on the property except with the expressed consent of the City of Bangor.
