Gould, Planning Officer SUBJECT: Amending Zoning Ordinance 180 Center Street Council Ordinance 10-197 Please be advised that the Planning Board at its meeting on June 1, 2010, held a Public Hearing on the above zone change request. Mr. Scott Deabay, owner of the property, noted that he met with the Code Office and the Planning Officer when it was determined that the existing building was larger than that allowed by the contract zone conditions. After discussion, it was decided to apply for a change to Neighborhood Service District instead of the contract Urban Service District. There were no other proponents or opponents to the rezoning request. Planning Officer Gould noted that the Comprehensive Plan Zoning Policy for this property was Neighborhood Service District. The District would allow Mr. Deabay's accounting office to continue limited to 2,000 square feet and he could utilize the other floor area for a non commercial use, possibly an apartment. Mr. Gould noted the rezoning essentially returns the property back to the way it was prior to Manna's use and building reconstruction back in the mid 1990's. Member Sturgeon asked what the differences were between NSD and USD (Urban Service District). Planning Officer Gould indicated that NSD is intended to be a neighborhood commercial zone, a limited, small scale neighborhood operation, like the mom & pop stores of earlier times. NSD limits hours of operation, drive thru businesses, consumption of alcohol and the overall intensity of use. The Urban Service District is open to a full range of land uses; auto service, drive thru banks, fast food, larger retail pharmacies, etc. Planning Board voted seven in favor and none opposed to recommend that the City Council adopt the proposed rezoning at 180 Center Street as contained in C.O. 10- 197.
