Date: December 14, 2009 Item/Subject: ORDER Authorizing the Execution of Consent to Assignment — Mobil Oil Pipe Line Company Easement Responsible Department: Legal Commentary: In 1973, the.City of Bangor granted a pipeline easement to Mobil Pipe Line Company for the right to lay, construct, maintain and operate pipelines for petroleum products under land of the City. That easement was replaced with another pipeline easement in 1991. Earlier this year, Irving Oil Terminals agreed to buy this facility and Mobil Oil Pipe Line Company's facility in Portland. The easement may not be assigned to Irving Oil Terminals without the express consent of the City. This Order will authorize the City Manager to execute the necessary document to consent to the assignment of the easement from the City of Bangor to Mobil Pipe Line Company to Irving Oil Terminals. ORDER, Authorizing the Execution of Consent to Assignment — Mobil Oil Pipe Line Company Easement WHEREAS, in 1973 the City of Bangor granted a pipeline easement to Mobil Pipe Line Company; and WHEREAS, that easement was replaced with another pipeline easement in 1991; and WHEREAS, the easement is for the right to lay, construct, maintain, and operate pipelines for petroleum products under land of the City; NOW, THEREFORE, BE IT ORDERED BY THE CITY COUNCIL OF THE CITY OF BANGOR THAT the City Manager, Edward A. Barrett, is authorized, on behalf of the City of Bangor, to execute the necessary document to consent to the assignment of the easement from the City of Bangor to Mobil Pipe Line Company to Irving Oil Terminals. Said document shall be in a final form as approved by the City Solicitor or Assistant City Solicitor.
