Item/Subject: Resolve, Ratifying Staff Action Applying for Benefits Under Municipal
Brownfelds Site Assessment Program.

Commentary:
The City is the owner of property at 498 Maine Avenue. The City is currently negotiating the sale
of the property to Bangor Gas. A condition of any sale would be that the City have an
environmental assessment of the site done. Regardless, because the site, part of the former Dow
Air Force Base, is known to have had a pump house, valve pits, pipelines, and underground
storage tanks an environmental assessment would be appropriate.
The Maine Department of Environmental Protection (DEP) has a Brownfield Program that has
grant funds to pay for the Phase I and Phase II environmental assessments. Under the program
the DEP selects and oversees the contractor to do the assessment. Wendy Warren, the City's
Environmental Compliance Officer submitted an application to the DEP seeking funding for the
assessments under the Brownfield Site Assessment Program and the DEP approved the
application. There is no requirement that the City participate financially.

CITY OF BANGOR
(TITLE.) Resolve, Ratifying Staff Action Applying for Benefits Under Municipal
Brownfields Site Assessment Program
WHEREAS, the Maine Department of Environmental Protection (DEP) has a program that will
provide Phase I and Phase II environmental site assessment at the DEP's expense;
and
WHEREAS, the City is currently negotiating for the sale of 498 Maine Avenue and as part of any
agreement will be required to do an environmental site assessment; and
WHEREAS, the staff applied under the DEP for benefits for an environmental site assessment
and DEP approved the application and will have a Phase I and Phase II
environmental site assessment of 498 Maine Avenue done at its expense.
BY THE CITY COUNCIL OF THE CITY OF BANGOR:
BE IT RESOL VED,
The actions of staff in making application for environmental site assessment benefits by Maine
Department of Environmental Protection are hereby ratified and affirmed.
