Responsible Department: Airport Commentary: At the Air Guard's request, the provision for cooperation on snow operations will be removed from the Joint Use Agreement and handled in a separate Memorandum of Understanding. The MOU will support our Joint Snow Removal and Ice Control Plan which is reviewed and agreed to annually. Under this MOU, the Air National Guard will provide the equipment and fuel for the snow removal equipment and the Airport will provide the vehicle operators. This continues our current practice which has worked well for both parties. ORDER, Authorizing the Bangor International Airport to enter into a Memorandum of Understanding (MOU) with the Maine Air National Guard regarding the use of snow removal equipment. WHEREAS, The City of Bangor owns and operates the Bangor International Airport; and WHEREAS, the Maine Air National Guard and the Airport operate have an interest in efficient and effective snow removal operations; and WHEREAS, the proposed MOU will support our Joint Snow Removal and Ice Control Plan which is reviewed and agreed'to annually; and WHEREAS, under this MOU, the Air National Guard will provide the equipment and fuel for the snow removal equipment and the Airport will provide vehicle operators; and WHEREAS, this MOU formalizes our current practices; and WHEREAS, the terms of this agreement are advantageious to both parties. NOW, THEREFORE, BE IT ORDERED BY THE CITY COUNCIL OF THE CITY OF BANGOR, That the Bangor International Airport is authorized to enter into a Memorandum of Understanding (MOU) with the Maine Air National Guard regarding the use of snow removal equipment. a draft copy of which is attached hereto. The lease shall be in a final form acceptable to the City Solicitor or Assistant City Solicitor. PURPOSE. Provide responsibilities for all snow removal equipment operations between the Maine Air National Guard (MeANG) and the City of Bangor (BIA). 2. GENERAL. SCOPE. This agreement describes the responsibilities, obligations, and costs for the use of Federal Snow Removal Equipment to be utilized at BIA for the winter season. These resources are owned and operated chiefly by the MeANG and at all pertinent times hereto these resources will be provided to BIA for the snow removal purposes of the City owned and operated areas as delineated in the FY10 Snow and Ice Control Plan. ASSUMPTIONS. (1) The MeANG and the Airport Department of The City of Bangor are joint tenants at the Bangor International Airport and; (2) A complete and proper Snow and Ice Control Plan for FY10 exists and has been fully and properly executed by the parties and; (3) BIA has a need for the use of snow removal equipment, and the MeANG has an excess or can make non essential equipment available to facilitate the operations of the civilian airport arena. 3. RESPONSIBILITIES. a. FINANCIAL MANAGEMENT. (1) BIA (receiver) will ensure all operators of the MeANG equipment are adequately trained to operate the type of equipment being used. The MeANG (supplier) must be content of the operator's proficiency with the equipment before the vehicular use is established. (2) BIA will ensure an adequate level and type (comprehensive and indemnity) of insurance is maintained on the equipment and for incidents likely to occur. Proof of such insurance shall be provided to the undersigned. (3) BIA agrees to compensate and/or reimburse MeANG for any and all repairs to damaged equipment caused by negligence. MeANG shall notify BIA immediately of any damage and vice versa. (4) 101 ARW is responsible for fuel. Each individual shall "top the tank" after vehicle use. Draft 4 Jan 2010 b. LOGISTICS SUPPORT. 10 1 �Cj (1) McANG is solely responsible for servicing the vehicles. 4. AGREEMENT AND ADMINISTRATION. (1) In witness thereof, the 101St Air Refueling Wing and Bangor International Airport has caused this agreement to be executed. This agreement is to become effective and operative upon the date of the last signature. (2) This agreement is effective indefinitely, but may be terminated at any time by mutual consent, or by written notification, at least 30 days in advance of proposed termination.
