Commentary:
This amendment adds Manufactured and Modular Homes to the list of outdoor display items allowed as a
conditional use in Shopping and Personal Service District. The S&PS District allows certain display items such
as boats, cars, trucks and construction equipment where the display area is limited.

(TITLE.) Ordinance, Amending the Land Development Code, Chapter 165: § 165-101 D Shopping
and Personal Service District — Conditional Uses - to add Manufactured or Modular Homes
Be it ordained by the City of Bangor, as follows:
THAT § 165-101D is hereby amended to add Manufactured or Modular Homes to to the list of outdoor
display items allowed as a conditional use in the Shopping and Personal Service District.
(8) Auto, truck, boat, manufactured or modular homes agricultural and construction machinery sales,
provided that:
(a) No facilities to service such vehicles, homes, boats or machinery are included.
(b) Outdoor display of products shall not exceed 50% of the gross floor area of the building (or
building area devoted to the use, whichever is less).
(c) No outdoor display or storage of products will be conducted in any side yard or rear yard.
(d) The requirements of Article XIX are met.
AND THAT Chapter 165- Schedule B be amended as attached.

MEMORANDUM

SUBJECT: Amending Land Development Code 165-101D and
Schedule B -Council Ordinance 10-039
Please be advised that the Planning Board at its regularly scheduled meeting on
January 5, 2010 held a public hearing on the above Land Development Code
Amendment.
Planning Officer David Gould explained that the proposed amendment was
intended to add Modular and Manufactured homes to the list of items that could
be displayed as a Conditional Use in the Shopping and Personal Service District
(S & PS). While S&PS is not the best district for outdoor display and storage the
Code does allow a limited amount of outdoor display where no service is
undertaken and the display area is limited to 50% of the primary building's floor
area. While the Board had previously discussed this amendment and considered
eliminating the floor area limitation, concerns were raised that the S&PS District
was not intended for extensive outdoor display and storage.
Board Member Theeman wondered if the limitation would be practical and if
not, then there would be little use for the amendment.
There were no proponents or opponents from the public in attendance.
Planning Board Members reviewed the locations of the General Commercial and
Service Districts and the Shopping and Personal Service Districts. The majority
of the Board agreed that outdoor display in the S&PS District would be limited
but should be allowed where the applicant desired to do it and could meet the
applicable performance standards. The Board voted six in favor and one
opposed to recommend the proposed amendment to add Manufactured and
Modular homes to the list of items available for outdoor display as a Conditional
Use in the Shopping and Personal Service District as contained in C.O. 10-039.
