Bangor School Department for the use of Building and Land at 208 Maine Avenue (Map 001 Lot
258)

Commentary: This Order will authorize the City Manager to execute an Amendment to an
Agreement with the City of Bangor School Department dated March 24, 2014 for use of property
located at 208 Maine Avenue to add the additional land.
On March 14, 2014 the City Council authorized an Agreement with the City of Bangor School
Department for use of property located at 208 Maine Avenue for the purpose of providing a
therapeutic day program for children with emotional or behavioral disabilities. The agreement
was assigned to the Southern Penobscot Regional Program for Children with Exceptionalities,
which operates the program.
Because of an increase in the number of students, the program needs additional space. In order
to place a portable classroom on the site and meet the requirements of the City's Land
Development Code, approximately 21,000 square feet of additional land is needed. This item
was reviewed and recommended for approval at the June 7, 2016 BED meeting.

(TITLE.) ORDER, Authorizing Execution of Amendment to Agreement with the City of Bangor
School Department for the use of Building and Land at 208 Maine Avenue (Map 001 Lot 258)
WHEREAS, the City of Bangor School Department provides a therapeutic day program for
children who have emotional or behavioral disabilities which impact their ability to be educated
in a traditional school environment; and
WHEREAS, on March 25, 2014 by Council Order 14118 the City Council approved an
agreement with the Bangor School Department for its occupancy and use of a building and land
at 208 Maine Avenue; and
WHEREAS, the Bangor School Department assigned its rights under the terms of the agreement
with the City to the Southern Penobscot Regional Program for Children With Exceptionalities to
run the program.
WHEREAS, the program is expanding resulting in a need for additional space; and
WHEREAS, additional building space requires additional land to meet requirements of the Land
Development Code and an amendment to the agreement between the City of Bangor School
Department to provide for more land.

THAT Catherine M. Conlow, City Manager, is hereby authorized on behalf of the City of Bangor,
to execute an amendment to the Agreement with the City of Bangor School Department dated
March 25, 2014, assigned to the Southern Penobscot Regional Program for Children With
Exceptionalities, to provide for additional land of approximately 21,000 square feet sufficient for
placement of additional buildings to meet the City's Land Development Code. Said Amendment
shall be in a final form as approved by the City Solicitor.
