Item/Subject: ORDER, Authorizing Submission of an Application to Reorganize
General -Purpose Foreign Trade Zone Number 58 to the Foreign -
Trade Zones Board Under the Alternative Site Framework.

Commentary: This Order authorizes the submittal of an application to reorganize Foreign -
Trade Zone (FTZ) No. 58 under the Alternative Site Framework. The City's FTZ designation can
provide companies with customs duty savings and logistical benefits that can help encourage
them to establish or maintain operations in Bangor. Access to the benefits of an FTZ can be an
important tool in economic development efforts. The proposed Alternative Site Framework plan
streamlines the FTZ application and thus reduces the cost for both the City and clients. This
item was reviewed and recommended by the Board of Directors of the BanAir Corporation and
by the Business & Economic Development Committee at its August 5, 2013 meeting.

(TITLE.) Order, Authorizing Submission of an Application to Reorganize General -
Purpose Foreign Trade Zone Number 58 to the Foreign -Trade Zones Board Under the
Alternative Site Framework.
WHEREAS, on June 18, 1934 Congress approved an Act "to provide for the establishment,
operation, and maintenance of foreign -trade zones in ports of entry of the United
States to expedite and encourage foreign commerce and for other purposes"
(hereafter the Foreign -Trade Zones Act's; and
WHEREAS, in accordance with the Foreign -Trade Zones Act and regulations relating thereto,
the City of Bangor did, on November 9, 1979 apply to the Foreign -Trade Zones
Board ("Board'I for a GRANT to establish, operate and maintain Foreign -Trade
Zone No. 58 at Bangor, Maine; and
WHEREAS, the City of Bangor has determined, in accordance with the Foreign -Trade Zones
Act and regulations relating thereto, that it is desirable to restructure Foreign -
Trade Zone No. 58 under the Alternative Site Framework as announced by the
Board in 74 Federal Register 1170 on January 12, 2009; and
WHEREAS, the City of Bangor by Council Order 287 AG authorized the formation of a local
development corporation, the Bangor Airport Civic Development Corporation; and
WHEREAS, the purposes of said corporation are to "foster, encourage and assist the physical
location, settlement, expansion and resettlement of industrial, manufacturing and
business enterprises and of recreational projects on or near Bangor International
Airport" to purchase, lease, otherwise acquire, hold, own, use, manage, operate,
enjoy, improve, develop and otherwise deal and trade in and with property, both
real and personal, of every kind and description, or any other improvements
thereon and therein and to sell, convey, and all lawful acts and things necessary
pertaining to any part thereof tending to increase the value, usefulness, comfort
or convenience of the property or any part thereof at any time held by said
Corporation, and to have or exercise all of the rights, powers and privileges
appertaining to corporations of a similar nature organized and existing under the
laws of the State of Maine ...; and

WHEREAS, the City of Bangor by Council Order 03-115 authorized the Bangor Airport Civic
Development Corporation to operate Foreign -Trade Zone No. 58.
BE IT ORDERED BY THE CITY COUNCIL OF THE CITY OF BANGOR
1. That the City of Bangor, Grantee of Foreign -Trade Zone No. 58, is hereby duly
authorized to submit an Application to reorganize General Purpose Foreign -Trade Zone No. 58
under the Alternative Site Framework and the Executive Director of the Bangor Airport Civic
Development Corporation (BanAir Corporation) is hereby authorized to execute an Agreement
with any prospective companies to be in the Zone.
2. That any subsequent Administrative Actions, such as the addition of a Usage
Driven Site Boundary Modification application to be filed at the Foreign -Trade Zones Board
relating to this application are also specifically authorized. This will provide the City of Bangor
with the ability to quickly react to a request by a company under the Alternative Site
Framework.
3. Itis also recommended that the City of Bangor designate Miller & Company, a
Professional Corporation, its' attorneys of record in connection with the Application for Foreign -
Trade Zone No. 58 under the Alternative Site Framework.
4. That this Order takes effect from and after its date of adoption.
