This ordinance clarifies that such structures are still required to undergo Historic Preservation Commission review, even when a building permit is not necessary, due to their effect on the historic character of properties. ORDINANCE, Amending Chapter 148, Historical Preservation, of the Code of the City of Bangor, By Clarifying the Definition of Structure WHEREAS, pursuant to state law, the City of Bangor has adopted the Maine Uniform Building and Energy Code; WHEREAS, the Maine Uniform Building and Energy Code does not allow municipalities to require building permits for fences six feet or less in height; and WHEREAS, given their effect on the historic character of properties, fences and similar structures on historic properties should still be subject to review by the Historic Preservation Commission; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR AS FOLLOWS, THAT Chapter 148 of the Code of the City of Bangor be amended as follows: § 148-2. Definitions. As used in this chapter, the following temps shall have the meanings indicated: Anything constructed or erected with a fixed location on the ground. or attached to something having a fixed location on the ground, including but not limited to mobile homes, buildings. walls, billboards, signs, piers and floats. fences, and retaining walls.
