BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BANGOR THAT
In accordance with 20-A MRSA Section 15690 1. A. and B., the following separate article appropriating
$19,307,697 as the City's contribution to the total cost of funding public education from kindergarten to
grade 12 is hereby approved.
Article 1: To see what sum the municipality will appropriate for the total cost of funding public
education from kindergarten to grade 12 as described in the Essential Programs and Services Funding
Act (recommend $36,286,431) and to see what sum the municipality will raise as the municipality's
contribution to the total cost of funding public education from kindergarten to grade 12 as described in
the Essential Programs and Services Act in accordance with Maine Revised Statutes, Title 20-A, section
15688
Recommend $19,307,697
Explanation: The municipality's contribution to the total cost of funding public education from
Kindergarten to Grade 12, as described in the Essential Programs and Services Funding Act, is the
amount of money determined by the state law to be the minimum amount that the municipality must
raise in order to receive the full amount of state dollars.

Maximum Spending Target Established by 20-A MRSA Section 15671 A. 4.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BANGOR THAT
In accordance with 20-A MRSA Section 15671 A. 4, the following separate article authorizing an
appropriation of $3,528,054 of local funds in excess of the maximum spending target is hereby
approved.
ARTICLE 3: The City of Bangor shall raise and appropriate, $3,528,054 in additional local
funds, which exceeds the State's Essential Programs and Services allocation model by $2,666,347 as
required to fund the budget recommended by the Bangor School Committee.
The Bangor School Committee recommends $3,528,054 of additional funds and gives the following
reasons for exceeding the State's Essential Programs and Services funding model by $2,666,347: Special
Education $760,328: Transportation $497,780: Co and extracurricular activities $959,778; Technology
$292,579; and Employee Benefits $155,882.
Explanation: The additional local funds are those locally raised funds over and above the school
administrative unit's local contribution to the total cost of funding public education from kindergarten to
grade 12 as described in the Essential Programs and Services Funding Act and local amounts raised for
the annual payment on non -state funded debt service that will help achieve the municipal budget for
educational programs.

Item/Subject: RESOLVES, Adopting the Fiscal Year 2014 School Department Budget

Commentary: At a June 18, 2013, election, residents of the City of Bangor approved a school
department budget. At the time of the election, the State of Maine's biennial budget had not
been approved, so the budget approved by the voters was based on existing law. The final
State of Maine budget resulted in the shift of certain retirement costs to the local school districts
as well as an increase in the funding of general purpose aid to education, which more than
offset the increased costs. As the State of Maine budget was finalized at the time the Council
adopted the overall City budget, the reduction in taxpayer funding needed for the operation of
the school department was factored in.
However, State law requires that the voters adopt the school department budget as well.
Therefore, it is necessary to adopt the following three resolves to bring the FY14 School
Department Budget in accordance with the requirements of LD 1.
1. Article 1 will appropriate the local share of the total costs of the Essential Programs and
Services funding model.
2. Article 3 will authorize the appropriation of local funds in excess of the maximum spending
target limit.
3. Article 4 will appropriate the total school budget.
The net impact of these articles was to reduce the local tax dollars needed to fund education
costs by $614,112.

Department as Required by 20-A MRSA Section 15690 4. A.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BANGOR THAT
In accordance with 20-A MRSA Section 15690 4. A., the following separate article authorizing a total
FY2014 School Department budget in the amount of $42,621,485 is hereby approved.
ARTICLE 4: To see what sum the municipality will authorize the school committee to expend
for the fiscal year beginning July 1, 2013 and ending June 30, 2014 from the school administrative units
contribution to the total cost of funding public education from kindergarten to grade 12 as described in
the Essential Programs and Services Funding Act, non -state funded school construction projects,
additional local funds for school purposes under the Maine Revised Statutes, Title 20-A section 15690,
unexpended balances, tuition receipts, state subsidy and other receipts for the support of schools.
Recommend $42,621,485
Explanation: The school administrative unit must include a summary article indicating the total annual
budget for funding public education from kindergarten to grade 12. The amount recommended must be
the gross budget for funding public education from kindergarten to grade 12. This article does not
provide money unless the other articles are approved.

Care Vouchers

Commentary: This Order will authorize the City Manager to enter into a Memorandum of
Understanding with Community Housing of Maine (CHOM) which will allow the City to use
Shelter Plus Care Vouchers at its proposed new CHOM development at the vacant school house
in Brewer. The City of Bangor's Health & Community Services Department is one of two Shelter
Plus Care Providers in Bangor. Shelter Plus Care vouchers provide permanent housing and wrap
around support services to adults and families impacted by mental health, substance abuse and
HIV/AIDS.
This has been reviewed and recommended for approval by the Government Operations
Committee on September 17, 2013.

Memorandum of Understanding
by and between City of Bangor
and Community Housing of Maine, Inc.
The mission of the City of Bangor's Health and Community Services is to provide for the public
health and welfare in an atmosphere that recognizes and encourages self-respect and self-
reliance. The Shelter Plus Care Program is a division of Bangor Health and Community
Services. With a mission to serve those facing these significant challenges, the Shelter Plus Care
Program provides subsidized housing vouchers to homeless families and individuals in the
greater Bangor area. The program also requires participants to receive case management
services specific to their needs to aid them in achieving greater self-determination through
gainful employment and acquisition of mainstream entitlements.
Community reintegration and assimilation remain the primary goal for Shelter Plus Care
Participants. Special priority is given to applicants who are chronically homeless and have
experienced many episodes of homelessness either on the street or in shelters.
Community Housing of Maine ("CHOM") is a 501(c)(3) private non-profit affordable housing
development organization that has been in operation since 1993. Headquartered at 309
Cumberland Avenue, Suite 203, Portland, Maine, CHOM focuses on acquiring, developing, and
rehabilitating housing, while partnering with service provider agencies whose expertise is to
provide support to tenants living in this housing.
This Memorandum of Understanding commits the City of Bangor to working over the next two
years to provide an opportunity for CHOM to project -base twelve (12) Shelter Plus Care rental
subsidies for the residents of the affordable rental apartment complex to be located at 131 State
Street, Brewer, Maine.
CHOM commits to fulfilling all the customary responsibilities of the General Partner in a
development project of this type, including, but not limited to, obtaining site control,
environmental review, market studies, all necessary permits, financing, regulatory approval, and
syndication of tax credits. After construction completion, CHOM will continue to be involved
through CHOM Development Corporation in the supervision of on-going property management
and in the relationship between the management company, the permanent lender, Maine State
Housing Authority, and any limited partners for the duration of the project. CHOM commits to
working with various service providers in the Bangor area for referrals of long-term homeless
populations and the provision of support services adequate to allow the success of each of the
referrals in this housing complex. CHOM commits to maintain the property as decent, safe, and
affordable to the population targeted and to work closely with the City of Bangor to serve
homeless, disabled, and/or special needs populations pursuant to the guidelines of the Shelter
Plus Care program. CHOM will collaborate with all involved with a goal of success in housing
for each of the tenants.
The City of Bangor and CHOM, and its designees, including any management company that
CHOM may retain, commit to close interaction and regular communication to resolve any
problems or issues that may arise. Issues will be promptly addressed to the satisfaction of all
parties involved. CHOM agrees to consult with the City of Bangor prior to all significant
decisions affecting the project, including but not limited to: (1) selection, retention, and
supervision of the project management company and individual property managers assigned by

project management company; and (2) conditions in the building affecting the quiet enjoyment
of the residents participating in the Shelter Plus Care program. CHOM and its property
management company agree to discuss tenant issues regarding Shelter Plus Care recipients,
including but not limited to potential evictions, with the City of Bangor prior to taking any action
so that a mutually satisfactory outcome can be attained. The City of Bangor and CHOM
acknowledge that clients referred for housing in this new affordable rental housing project must
meet MaineHousing, US Department of Housing and Urban Development, Section 8, and/or
Internal Revenue Services income and eligibility requirements.

Item/Subject: Resolve, Authorizing the City Engineer to Proceed With Permitting of Left
Turn Movement on Stillwater Avenue, Exit 186

Commentary: This resolve will authorize the City Engineer to contact the State of Maine
Department of Transportation Commissioner to work toward the resolution of lifting the "No
Left Turn" prohibition on Stillwater Avenue at Exit 186.
The City continues to be approached regularly to remove the prohibition on the left turn from I-
95 S onto Stillwater Avenue. As this involves the interstate system, which was funded and
constructed by the State, the City needs to work with the Maine Department of Transportation'
and the Federal Highway Administration requirements to permit for a left turn off of exit 186.
As part of that process, the City was required and has sought feedback from members of the
public through surveys contained in both the sewer bills and by email. Results indicate that
over 80% of the citizens surveyed were in favor of the "no left turn" being lifted to allow access
to area residences and businesses.
In order to continue forward, the City Council would need to express support for the project.
Should the City Council concur, approval of this order expresses Council support for and
recommends proceeding with communications with Maine DOT and the Federal Highway
Administration to take the necessary requirements to lift the "no left turn" prohibition on to
Stillwater Avenue from I-95, Exit 186.
