HomeMy WebLinkAbout2013-09-23 13-310 ORDINANCECOUNCIL ACTION Item No. 13-310 Date: September 23, 2013 Item/Subject: ORDINANCE, Amending Chapter 165, Land Development Code, of the Code of the City of Bangor, By Expanding Parking for Small Commercial Vehicles Responsible Department: Legal Commentary: This ordinance will amend Chapter 165 of the Land Development Code, to expand parking for small commercial vehicles. If approved, this ordinance will allow owners of small trucks to park them overnight at their homes and would raise the weight limit for vehicles parking more than four hours in residential districts from 3/4 ton to one ton. The City Code does not currently allow commercial vehicles larger than 3/4 ton to park for more than four hours in residential districts. This ordinance was put into place a number of years ago, however, before one ton pickup trucks were common. The purpose of this change is to bring the ordinances in conformity with common practice. ORDINANCE, Amending Chapter 165, Land Development Code, of the Code of the City of Bangor, By Expanding Parking for Small Commercial Vehicles WHEREAS, commercial vehicles in excess of 3/4 ton are not presently allowed to be parked for more than four hours in a residential district; WHEREAS, a substantial number of pickup trucks are now in the 1 ton truck category; WHEREAS, many small business owners and operators use 1 ton pickup and similar trucks in the course of business; and WHEREAS, many of these small business owners and operators are Bangor residents who use these same trucks to commute to and from work; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR AS FOLLOWS, THAT Chapter 165 of the Code of the City of Bangor be amended as follows: § 165-71. Residential districts. A. In a residential district, use of parking spaces shall be limited to noncommercial vehicles,Imus one vehicle of wee-feats-teR one -ton capacity or less per dwelling unity when primarily intended for personal or limited business use. B. Commercial vehicles in excess of 3/4 one ton may not be parked or stoned in a residential district except for periods up to four hours.
