Commentary:
The proposed ordinance would prohibit the feeding of animals and birds so as to create a
disturbance or unsanitary condition. A typical bird feeder or similar arrangement would not be
affected by this ordinance.
Residents on Drew Lane have expressed concern about the attraction of animals, and in
particular birds, by the placing of large amounts of grain and other food on the ground. This can
present a health, safety, and welfare concern, in the form of unsanitary conditions, large
concentrations of wild animals, and noise and other disturbance.
Violation of the enforcement provision with this ordinance requires a minimum fine of $50 for
the first offense, $100 for the second, and $200 for the third and subsequent offense within a
year of previous violations. As these are minimums, greater fines can be assessed if necessary.
The Government Operations Committee recommended approval of this ordinance on May 20,
2013.

Feeding of Animals and Birds so as to Create a Disturbance or Unsanitary Condition
WHEREAS, excessive feeding of animals and birds can lead to unsanitary conditions and otherwise
disturb the health, safety, and welfare of property owners and others;
BE IT ORDAINED BY THE CTTV COUNCIL OF THE CITY OF BANGOR AS FOLLOWS, THAT
Chapter 65 of the Code of the City of Bangor be amended as follows:
A. No person shall fail to immediately remove and lawfully dispose of any feces left in any street,
sidewalk, esplanade, park or other public place or city -owned property by a dog owned by such
person or under his/her control. This r gulation shall not apply to a dog accompanying any
handicappdpgrson who. by reason of his/her handicap. is physically unable to comply with the
Eiguirements of this section.
