HomeMy WebLinkAbout2013-04-08 13-128 ORDERCOUNCIL ACTION Item No. 13-128 Date: April 8, 2013 Item/Subject: ORDER, Designating Bangor Housing Development Corporation Tentative Developer of Freese Building Condominium — 96 Main Street Responsible Department: Legal Commentary: This Order, if approved, will designate the Bangor Housing Development Corporation as the tentative developer of the City owned condominium unit in the former Freese Building, Main Street, Bangor. In December, The City issued a Request for Proposals (RFP) for the development of the Freese unit and received three proposals. After a thorough review of the proposals, the selection committee recommends that the City enter into an agreement with the Bangor Housing Development Corporation for the redevelopment of the Freese Condominium. The Bangor Housing Development Corporation proposed a mixed use project that includes 10 market rate lofts on the top floors with some type of commercial use on the first floor. The Housing Development Corporation was selected because of their development experience and because their proposal included the highest level of investment. If approved, this designation shall be in effect until October 15, 2013. During the period of designation, the City will deal exclusively with Bangor Housing Development Corporation for the purpose for the redevelopment of the City owned condominium unit in the former Freese Building. Additionally, City staff is authorized to negotiate a final development agreement with Bangor Housing Development Corporation for the City Council's Consideration setting forth the proposed terms and conditions under which the proposed development would be allowed to move forward. This item was reviewed and recommended for approval by the BED at its April 2, 2013 meeting. ORDER, Designating Bangor Housing Development Corporation Tentative Developer of Freese Building Condominium — 96 Main Street WHEREAS, the City of Bangor is the owner of a condominium unit in the former Freese Building on Main Street; and WHEREAS, the City of Bangor issued a Request for Proposals (RFP) for the development of the condominium unit; and WHEREAS, Bangor Housing Authority Development Corporation, along with others, submitted a proposal in response to the RFP; and WHEREAS, the City has granted "tentative developer" status to potential developers on various City owned development sites in the past, thereby providing the developer and the City time to prepare a development agreement for the City Council's consideration and during which time the City agrees to deal exclusively with the designated tentative developer for the purpose for which tentative developer status was granted; and WHEREAS, it is in the best interest of the City to designate Bangor Housing Development Corporation as "tentative developer" of the condominium unit in the former Freese Building in order to allow time for the City and Bangor Housing Development Corporation to negotiate a development agreement for consideration by the City Council. NOW, THEREFORE, BE IT ORDERED BY THE CITY COUNCIL OF THE CITY OF BANGOR THAT, Bangor Housing Development Corporation is hereby designated the tentative developer of the City owned condominium unit in the former Freese Building, Main Street, Bangor. This designation shall be in effect until October 15, 2013. During the period of designation, the City agrees to deal exclusively with Bangor Housing Development Corporation for the purpose for the development of the City owned condominium unit in the former Freese Building and City staff is authorized to negotiate a development agreement with Bangor Housing Development Corporation for the City Council's consideration setting forth the proposed terms and conditions under which the proposed development would be allowed to move forward.
