Commentary: This ordinance will amend Chapters 265-E and 1 F; and Chapter 265-5AA and
5A6 of the Code of Ordinances dealing with Solid Waste. The purpose of theses amendments is
to add a provision that allows the City to charge a non-resident user fee for the Organic Waste
Disposal Area. Currently, the City does not charge any haulers of organic waste a fee. This
Ordinance will require non-resident haulers to obtain a permit through the City. This item was
reviewed and recommended for approval at the Infrastructure Committee on March 12, 2013.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR
THAT,
Chapter 265 of the Code of the City of Bangor be amended as follows:
CHAPTER 265. SOLID WASTE
§265-1. Collection and disposal.
No person, corporation or legal entity shall dispose of solid waste in any manner which is contrary to
the provisions of this section, as hereinafter described.

E. Organic Waste. The Public Works Department shall provide a facility to accept organic waste.
Acceptable organic waste shall include tree. brush. wood chips, grass clipping and other vegetated
matter. Organic waste that shall not be accepted at the Public Works Department Facility shall
include. tree stumps. demolition debris. food waste and invasive plant species.

§265-5. Violations and penalties.
A. The following shall constitute violations of this chapter and shall be punishable by fine or waiver
fees as set forth:
(1) Failure to remove uncollected waste. Unchanged.
(2) Disposal of rubbish and garbage on public or private property. Unchanged.
(3) Unauthorized use of commercial or private containers. Unchanged.
(4) Unauthorized taking of solid waste or recycling items. Unchanged.
(5) Unauthorized taking_of organic waste. No persons not permitted to do so by the City of
Bangor shall take any organic waste to the Public Works Department without a permit.
