Item/Subject: Ordinance, Amending Chapter 61, Alcohol and Entertainment, of the Code
of the City of Bangor - B.Y.O.B. Function Permits and Off -Premises Catering Licenses

Commentary: This ordinance amendment will authorize the City Clerk to sign applications for
BYOB Function Permits and Off Premise Catering Licenses. These applications are for one-time
events that occur within the City. State law requires signatures of the municipal officers or the
signature of a municipal official designated by the municipal officers. These applications may be
filed within 24 hours which creates a difficult in obtaining a majority of the signatures of the
City Council.
This ordinance change will delegate to the City Clerk the authority to sign the applications once
approval has been obtained from the necessary City departments. This amendment will also
establish a $25.00 application fee for the BYOB Function Permit. Current ordinance contains a
fee for the Off Premise Catering Licenses.

(TITLE.) Ordinance, Amending .Chapter. 61, Alcohol and Entertainment, of the Code of the City of
Bangor - B.Y.O.B. Function Permits and Off -Premises Catering Licenses
WHEREAS, Maine law requires that a person applying for a bring your own bottle (B.Y.O.B.) function
apply for a permit and obtain written approval from the municipal officers or a municipal official
designated by the municipal officers; and
WHEREAS, the application may be filed 24 hours prior to the event; and
WHEREAS, an application filed in compliance with Maine law will often create potential delays for the
applicant because of the difficulties in obtaining the signatures of the majority of the municipal officers
on 24 hours notice; and
WHEREAS, the City Clerk's office processes applications for a B.Y. O. B. function permit; and
WHEREAS, Maine law requires a license for off -premises catering for the sale of liquor; and
WHEREAS, the application may be filed 24 hours prior to the event; and
WHEREAS, an application filed in compliance with Maine law will often create potential delays for the
applicant because of the difficulties in obtaining the signatures of the majority of the municipal officers
on 24 hours notice; and
WHEREAS, the City Clerk's office processes applications for an off -premises catering license.
NOW, THEREFORE, BE IT ORDAINED BY THE CIN COUNCIL OF THE CITY OF BANGOR THAT,
Chapter 61 of the Code of the City of Bangor be amended as follows:
ARTICLE III - B.Y.O.B. Function Permits and Off -Premise Catering Licenses
1561-26 License required for B.Y.O.B Permit
No person, firm or corporation shall conduct a B.Y.O.B. function without first having obtained a license
therefor, to be issued by the City Council's designee as provided by 28-A M.R.S.A. X163 (2) (E) said
designee to be the City Clerk of the City of Bangor.
461-27 License required for B.Y.O.B Permit
The license fee shall be $25.00.

No person, firm or corporation shall conduct an off -catering function without first having obtained a
license therefor, to be issued by the City Council's designee as provided by 28-A M.R.S.A. X1052 (4)
(G) said designee to be the City Clerk of the City of Bangor.
