HomeMy WebLinkAbout2013-02-11 13-076 ORDINANCECOUNCIL ACTION Item No. 13-076 Date: February 11, 2013 Item/Subject: ORDINANCE, Amending Chapter 295, Victualers, of the Code of the City of Bangor, By Removing Outdated References to Health Inspections Responsible Department: Clerk Commentary: This ordinance amendment will remove an outdated reference to health inspection certificates from the victualers license requirements in the Bangor City Code. In the past, the City performed health inspections of Bangor restaurants prior to the issuance of a victualers license. A recent change in State Statute resulted in health inspections being taken over by the state, thereby removing those duties from the City. Additionally, the amendment clarifies that the Fire Prevention Office is the office responsible for ensuring victualer adherence to fire and life safety codes. Ordinance, Amending Chapter 295, Victualers, of the Code of the City of Bangor, By Removing Outdated References to Health Inspections WHEREAS, health inspection of victualers In the City of Bangor is now performed by the State rather than the City's Code Enforcement Office; WHEREAS, formal inspection certificates are not necessary to inform the City Clerk whether other departments have affirmed that a victualer meets City requirements; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR AS FOLLOWS, Chapter 295 of the Code of the City of Bangor be amended as follows: § 295-1. License requi . No person, firm or corporation shall operate as a victualer until such person, firm or corporation first obtains a license for such purposes from the City Clerk. Licenses under this chapter shall not be issued unless the applileant presents evidenee, In City Clerk receives affirmation from the City Code Enforcement Officer; that the applicant's proposed operation meets all applicable zoning and site plan requirements, health eedes and affirmation from the Fire Prevention Office that the applicant's proposed operation meets all applicable fire and safety codes.
