HomeMy WebLinkAbout2013-07-22 13-247 ORDERCOUNCIL ACTION Item No. -13-247 Date: July 22, 2013 Item/Subject: ORDER, Ratifying City Staff Action in Executing a Purchase and Sale Agreement for a Dangerous Building at 150 Court Street Responsible Department: Code Commentary: This Order ratifies a Purchase and Sale Agreement in which the City agreed to acquire 150 Court Street in exchange for forgiveness of back taxes on the property. In January, the structure at 150 Court. Street was severely damaged by fire. The personal representative of the estate that owns 150 Court Street has agreed to allow the City to have the property in exchange for relief of back taxes. This allows the City to demolish the house without the time and expense of a court process. Until the fire, the personal representative lived in the house in question. In order to assist him in qualifying for rent payment assistance for a new apartment, the Purchase and Sale Agreement needed to be completed by July 1, 2013. If approved, this Order would ratify action taken by staff in signing the Agreement to meet the deadline. Assigned to Councilor Civiello "jP\li -fie . =; CITY OF BANGOR �RRiED,fE r ORDER, Ratifying City Staff Action in Executing a Purchase and Sale Agreement for a Dangerous Building at 150 Court Street BE IT ORDERED BY THE CITY COUNCIL OF THE CITY OF BANGOR, THAT WHEREAS, the structure located at 150 Court Street, Bangor, more particularly described in a deed recorded in the Penobscot County Registry of Deeds in Book 2354, Page 16 (hereinafter uthe Building"), suffered considerable damage in a fire in January of this year; WHEREAS, the Code Enforcement Office inspected the Premises and determined that the Building is unsafe, unstable, and suffers from numerous code violations; WHEREAS, the Premises is owned by the Heirs of Justina Barrows of Brewer, Maine (hereinafter the "Owner"); WHEREAS, the personal representative of the Owner, who had been living in the Building until the time of the fire, is unable to pay for the demolition or other mitigation of the. Building; WHEREAS, as of June 25, 2013, $3,345.50 was owed in property taxes on the property at 150 Court Street; WHEREAS, the aforementioned personal representative indicated his willingness to give the property to the City in exchange for relief of the property taxes due; and WHEREAS, in order to qualify for certain rent payment assistance, the aforementioned personal representative requested that a Purchase and Sale Agreement be completed for the property by July 1, 2013; BE IT ORDERED THAT: The Purchase and Sale Agreement completed between the City of Bangor and Gregory Barrows, in his capacity as personal representative of the Estate of Justina Barrows, for the sale of the property at 150 Court Street in exchange for forgiveness of all property taxes due to the City on the date of closing is hereby ratified.
