HomeMy WebLinkAbout2013-03-25 13-120 ORDERCOUNCIL ACTION Item No. 13-120 Date: March 25, 2013 Item/Subject: ORDER, Authorizing Execution of Documents by and Between the City of Bangor Penobscot Community Health Center and Penobscot Community Health Center - Hope.House Responsible Department: Legal Commentary: Penobscot Community Health Center d/b/a Penobscot Community Health Care (hereinafter PCHC) is a party to two leases with the City of Bangor. The first -is for the Shelter and the second is for transitional housing. PCHC has been notified that it has been awarded a grant of $1.8 for improvements to the property including the construction of a building to join the two existing buildings. This Order, if approved, will authorize the City Manager to execute any and all documents necessary to lease the properties to PCHC with amended terms and conditions. The documents will include certain terms and conditions, including, but not limited to, rent of $1.00 per year; a payment in lieu of taxes of 30% to be divided between the property of PCHC known as Auburn Hall and that known as Hope House; a term of 30 years; a requirement that PCHC's receives a Maine State Housing Authority grant; receipt of required permits and completion of construction; provisions for cross -defaults in leases; provision that default of funding conditions is a default of the agreements; a provision that limits the number of sex offenders 7; a provision that PCHC will only accept sex offenders sentenced in Penobscot County; a provision that the number of units of transitional housing will be limited to 48; a provision that the number of person in the shelter will be limited to 66; and a provision that PCHC will contribute a minimum $5,000 to the University of Maine at Augusta Bangor campus for repairs or improvements to fence on the Union Street side of the University property. ORDER, Authorizing Execution of Documents by and Between the City of Bangor and Penobscot Community Health Center d/b/a Penobscot Community Health Care - Hope House WHEREAS, the City of Bangor leases two properties to Penobscot Community Health Center; and WHEREAS, Penobscot Community Health Center operates and shelter facility and a transitional housing facility on said leased properties; and WHEREAS, Penobscot Community Health Center has been notified by the Maine State Housing Authority that it has been awarded a grant of $1.8 for improvements to the property including the construction of a building to join the two existing buildings; and WHEREAS, Penobscot Community Health Center has requested that the City amend it leases in order to proceed with the project approved by the grant. By the City Council of the Oty of Bangor: ORDERED, That Catherine M. Conlow, City Manager, is hereby authorized, on behalf of the City of Bangor to execute, any and documents necessary to amend or replace the existing leases with Penobscot Community Health Center, including a development agreement, in order for it to proceed with a development and improvements as approved by a grant from the Maine State Housing Authority on the property currently leased from the City of Bangor by Penobscot Community Health Center. Said documents shall include certain terms and conditions, including, but not limited to, lease of land between land currently leased to PCHC and Illinois Avenue; rent of $1.00 per year; a payment in lieu of taxes of 30% based upon the valuation of Hope House to be divided between the property of PCHC known as Auburn Hall and that known as Hope House; a term of 30 years; a requirement that PCHC receives a Maine State Housing Authority grant; receipt of required permits and completion of construction; provisions for cross -defaults in leases; provision that default of funding conditions is a default of the agreements; a provision that limits the number of sex offenders to 7; a provision that PCHC will only accept sex offenders sentenced in Penobscot County; a provision that the number of units of transitional housing will be limited to 48; a provision that the number of persons in the shelter will be limited to 66; and a provision that PCHC will contribute a minimum $5,000 to the University of Maine at Augusta Bangor campus for repairs or improvements to the fence on the Union Street side of the University property. Said documents shall be in a final form as approved by the City Solicitor or Assistant City Solicitor.
