Commentary:
The proposed text amendment will add the definitions for "Emergency Shelter" and "Transitional
Housing" to the Definitions Section of the Land Development Code.

WHEREAS, the City's Land Development Code currently does not define transitional housing or
emergency shelters.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR THAT,
Chapter 165 of the Code of the City of Bangor be amended as follows:
ARTICLE II — Words Usage and Definitions
§165-13 Definitions
Emergency Shelter — A facility oaerated by a not for profit corporation or public agencyl2roviding
temporary overnight shelter to homeless individuals, which provides shelter to no more than 70
Individuals per night.
Transitional Housing — Housing that is provided short term (24 months or less) for various individuals
where occupancy is anticipated for the duration of a month or more in association with a program of
sugportive services for the residents.
Additions are underlined.

Amending Land Development Code Chapter 165-13,
Definitions
Council Ordinance 13-105
Please be advised that the Planning Board at its meeting on May 7, 2013, held a
Public Hearing on the above zoning amendment.
Planning Officer David Gould reviewed the proposed amendments to add two
definitions to the Land Development Code dealing with Emergency Shelters and
Transitional Housing. Both definitions were designed intentionally not to include
elements that may be problematic such as size of space, type of appliances, etc.
Mr. Gould did note that the definition of Emergency Shelter did include a
limitation of 70 individuals per night.
Board members asked if the new definitions would expand where such uses
might be located.
Mr. Gould noted that presently shelters are allowed as Community Service
Organizations in DDD and USD. The Bangor Area Homeless Shelter is in an Urban
Service District (USD). Shelters would likely fit into the Government and Institutional
Service District by the basic nature of the District.
While Transitional Housing is more of a subset of housing than traditional market
or subsidized housing, so it seems suited to a location where other service providers
could be located.
The Board voted 6 in favor and 1 opposed to recommend the proposed text
amend to the City Council - Land Development Code Chapter 165-13 Definitions,
Council Ordinance 13-105.
