COUNCIL ACTION Item No. 17-055 Date: December 28, 2016 Item/Subject: ORDINANCE, Amending Chapter 165, Land Development Code, and Chapter 234, Public Property, of the Code of the City of Bangor by Making Procedural Changes Responsible Department: Legal Commentary: This set of ordinance amendments would make a number of procedural changes to the City's Land Development Code. These changes are designed to clarify Code requirements, reflect current practices, add best practices, and provide additional flexibility for developers where appropriate. Notable changes include the following: • Acknowledgement of the role of the Staff Coordinator, a position intended to provide a single point of contact for developers. • Addition of provisions regarding digital plans and digital as -built plans, in order to make use of improved mapping and GIS technology. • Addition of procedures to allow phased development of subdivisions and mobile home parks so long as infrastructure is in place for the developed lots. • Relocation of a section on shade trees to a different Code chapter. This item was discussed at the Business and Economic Development Committee meeting on November 22, 2016, and the Planning Board on December 6, 2016. A few minor changes resulted from comments by the Planning Board, primarily clarifying the process for receiving temporary certificates of occupancy. The ordinance amendments are otherwise unchanged. Gould, Planning Officer SUBJECT: Amending Zoning Ordinance Chapter 165- amending numerous sections -Council Ordinance 17-055 Please be advised that the Planning Board at its meeting on January 3, 2017, held a Public Hearing on the above Zoning Amendment to update the Land Development Code in many sections in the handling and processing of applications, Site Plan thresholds, digital informational and other topics. Chair Kenney opened the Public Hearing and Assistant City Solicitor Paul Nicklas provided the Board with an update on changes made since the last time this was reviewed by the Board. There were no other proponents or opponents to the proposed text amendment. There was some discussion surrounding whether the Ordinance implied business days or calendar days. Solicitor Nicklas noted that unless stated it is implied calendar days which is throughout the Code. Member Boothby made a motion to recommend 17-055 be adopted by the City Council Member McCarthy seconded the Motion and the Board voted six in favor and one opposed to recommend C.O. #17-055 be adopted by the City Council.
