The buses were purchased in Texas and delivered to the MMA facility in Limestone. MMA has expressed an interest in assigning the contract to Loring Industries (Loring). Additionally, the City, MMA and Loring have also asked to amend certain terms of the contract. In order to ensure the City receives its four buses, but remains in compliance with federal regulations, staff recommends allowing assignment and amendment of the contract under the following terms: • The contract is assigned in its current form from MMA to Loring, • The City then signs an amendment with Loring as a separate document. • The amendment includes language allowing for certain parts to be inspected and replaced only as necessary, as opposed to automatically replaced. • The amendment will also include certain required federal contract clauses. This item was discussed at the Finance Committee meeting on January 3, 2017.
