Vice Chair Boucher called the meeting to order at 7:00 P.M.
OLD BUSINESS
1. Meeting Minutes — May 20, 2025
Member Huhn moved to approve the minutes of May 20, 2025, seconded by Member Brush. All voting
members in favor, none opposed. Motion passed.
NEW BUSINESS
PUBLIC HEARING - LAND DEVELOPMENT CODE AMENDMENTS
2. To amend the Land Development Code by adding flexibility to the reconstruction
requirements for existing manufactured home parks constructed prior to 1971.
Planning Officer Anja Collette presented the agenda item and gave an overview of the proposed amendment.
Collette also provided a summary of Chair Perkins' written comments, received by staff via email. These
included that §165-121D(1-a) regarding the park size seemed unnecessary, that recreation areas should be
required for parks of all sizes (or a majority at least), and that the site evaluator required for shared septic
systems should be licensed by the State of Maine. Collette clarified for the Board that any changes to the
ordinance couldn't be done via an amendment, so if the Board desires to make any of these changes, the
ordinance would have to go back through the process of first reading, Planning Board, and Council. Collette

also reminded the Board about the upcoming Land Development Code update and that if there are issues with
unnecessary or redundant language, it can be addressed during that time as well.
Member Jonas asked approximately how many parks/units this amendment will cover— Planning Officer
Collette responded that it would cover about 2-3 parks, but each one is estimated to have at least 50 units, so
a large number of units could be affected.
Member Huhn asked to clarify that the requested action is a recommendation to City Council —Vice Chair
Boucher confirmed that it is.
Member Jonas asked about a portion of the ordinance regarding dead end streets and asked whether this
meets emergency vehicle requirements — Planning Officer Collette confirmed that Fire was good with this
because of the requirement for a turnaround at the end.
Vice Chair Boucher mentioned that the 50+ unit requirement for recreational space is met by the existing
parks, so felt that Chair Perkins' comment regarding this would be satisfied — Planning Officer Collette clarified
that the 50+ number of units in the existing parks is just an estimate. Boucher stated that an increased
requirement for recreation areas could result in displaced units.
Vice Chair Boucher opened the public comments—there were none. Vice Chair Boucher closed the public
comments.
Member Huhn moved that the Board recommend to City Council that the proposal to amend the Land
Development Code by adding flexibility to the reconstruction requirements for existing manufactured
home parks constructed prior to 1971 ought to pass. Seconded by Member Bazinet. Roll call vote
conducted —all in favor, none opposed. Motion passed.

square footage of temporary commercial vendors in the Waterfront Development
District.
Planning Officer Anja Collette presented the agenda item and gave an overview of the proposed amendment.
Parks & Recreation Director Tracy Willette presented to the Board via Zoom and confirmed that he had no
additional comments regarding the proposed amendment.
Vice Chair Boucher asked whether this would apply only in the parking lot area— Planning Officer Collette
clarified the existing area and that this amendment would apply to the entire Waterfront Development District.
Boucher also asked if permits for temporary sales are separate from those for events —Collette confirmed that
they are and that events are covered by a separate policy.
Vice Chair Boucher opened the public comments—there were none. Vice Chair Boucher closed the public
comments.

Member Brush moved that the Board recommend to City Council that the proposal to amend the Land
Development Code by removing the limitations on number and square footage of temporary commercial
vendors in the Waterfront Development District ought to pass. Seconded by Member Jonas. Roll call vote
conducted —all in favor, none opposed. Motion passed.
OTHER BUSINESS
Planning Officer Anja Collette noted that Chair Perkins had asked to open an item for discussion —clarification
re: Land Development Code amendment that was discussed at the last meeting. Collette stated that Perkins
wanted to point out to the Board that the amendment for projects with code violations only applied to violations
of the land development code and not other parts of the City's code and that this was a desire of City Council.
Boucher asked for examples of other parts of the code that would no longer apply. Collette mentioned the
building code and vacant properties.
Member Huhn mentioned the zoning article that had been included in Board members' packet for this meeting
and wondered if some of the lighting protocols and terminology addressed would be seen more frequently in
future applications before the Board. Collette stated this could be discussed with the consultants for the land
development code update if the Board wanted to pursue it. Member Jonas expressed support for exploring this
type of zoning in more depth. Collette mentioned that a City lighting policy was also being evaluated and that it
should be consistent with the land development code lighting rules.
