HomeMy WebLinkAbout2025.07.16 BOA Minutes Bangor Farmers' Market - HearingBoard of Appeals Minutes For Meeting Held on July 16, 2025 at 5:15 p.m. Members Present:Jordan LaBouff, Edward Gould (Chair), Robert Ballingall, Robin Perkins, Rachel Thompson,and Donald McCann (Associate Member). Staff Present:Grace Innis, Assistant City Solicitor Introductions: Chair Gould opened the hearing and introduced members. Chair Gould advised Associate Member McCann that hewill not vote, but he can participate as an Associate Member. Approval of Minutes: May 29, 2025: Member Ballingall made a motion to approve the meeting minutes. Member Perkins seconded the motion. Motion passed (5-0). Public Hearing – ApplicantBangor Farmers’ Market Association, for consideration of an appeal under City Ordinance § 165-26, to allow a temporary storage building at the Abbot Square parking lot located at 108-148 Harlow Street. Chair Gould introduced the public hearing. Everett Ottinger spoke as the Applicant and presented his appeal. Board of Appeals members asked questions. City of Bangor Code Enforcement Officer Jeff LaBree presented the City of Bangor’s position. Citizens Myer Taksel, Rod Hathaway, Emily Grassie, Andrew Toothacker, and Daniel Krenzelok spoke in support of the Applicant. No one spokein opposition to the application. Public hearing was closed. Board of Appeals deliberated on the matter. Board of Appeals voted on the matter. Member Ballingallmade a motion that the use of the temporary storage container, in combination with the primary use and accessory uses on the same lot, does not exceed maximum lot coverage requirements as set forth in the chapter for the district in which it is to be located. Member Thompsonseconded the motion. Motion passed (5-0). Member Thompson made a motion that there is a valid temporary need which cannot be met within the principal structure and that an adequate operational hardship can be shown if the request is not granted. Member Ballingallseconded the motion. Motion passed (5-0). Member Perkins made a motion that the initial approval, or any renewal, of the use will not in any way be detrimental to the neighboring properties, including aesthetic impact. Member Thompsonseconded the motion. Motion passed (5-0). Member Ballingall made a motion that the use is not intended as a permanent or long-term use. Member Perkinsseconded the motion. Motion passed (5-0). Member Perkins made a motion that the use is not intended to circumvent building area limitations for that district. Member Thompsonseconded the motion. Motion passed (5-0). Member Thompson made a motion that the use will be adequately screened from neighborhood properties and the street. Member Perkinsseconded the motion. Motion passed (5-0). Member LaBouff made a motion that the use will not be used as or intended for advertising for on- or off-premises purposes. Member Ballingallseconded the motion. Motion passed (5-0). Member Thompson made a motion that the use is not intended for retail sales. Member Ballingallseconded the motion. Motion passed (5-0). Member Ballingall made a motion to grant the request to allow a temporary storage building at the Abbot Square parking lot located at 108-148 Harlow Street. Member Thompsonseconded the motion. Motion passed (5-0). Other business: None. Meeting adjourned. Member Perkins made a motion to adjourn. Member Thompson seconded the motion. Motion passed unanimously (5-0) to adjourn.
