Summary
This Ordinance would amend the Land Development Code, District Map to re -zone a portion of the property at
Map -Lot R24-017, located at 1017 Union Street, from Government & Institutional Service District (G&ISD) to
Shopping & Personal Service District (S&PS). The total area requested to be changed is approximately 0.22
acres. The applicant is Nathan Woodard and the owner of record is Encompass Health Maine Real Estate, LLC.
This area is within the growth boundary shown in the 2022 Comprehensive Plan and the future land use map
in the Plan shows this property in the Neighborhood Residential area which consists of "medium -density
residential development with limited commercial and institutional uses that are complementary to the
surrounding residential land uses".

WHEREAS, the land uses around the property consist primarily of a mix of commercial and institutional;
WHEREAS, the zoning around the property consists primarily of Government & Institutional Service District
(G&ISD) and Shopping & Personal Service District (S&PS);
WHEREAS, the 2022 Comprehensive Plan and the future land use map in the Plan shows this property in the
Neighborhood Residential area which consists of "medium -density residential development with limited
commercial and institutional uses that are complementary to the surrounding residential land uses";
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR AS FOLLOWS, THAT
Chapter 165 of the Code of the City of Bangor, District Map, is amended to reclassify a portion of the property
at R24-017, located at 1017 Union Street, from Government & Institutional Service District (G&ISD) to
Shopping & Personal Service District (S&PS). The total area requested to be changed is approximately 0.22
acres and is shown in the attached exhibits.

Regarding: 1017 Union Street - Map-Lot R24-017 - Government & Institutional
Service District (G&ISD) to Shopping & Personal Service District
(S&PS)
Please accept this memorandum as the recommendation from the Planning Board on
the above-noted agenda item. The hearing was duly posted, advertised and noticed.
All members were present and voting on the zone change application. There were no
abutters present, and there was no public comment on the application.
The applicant is Nathan Woodard of Kenduskeag, Maine. The owner is Encompass
Health Maine real Estate LLC of Birmingham, Alabama. This change seeks to correct
the split zone lot, as well as accommodate future lot line adjustments for the entry road
for the development for Encompass Health.
From the staff inemo to the Planning Board:
1) The applicant is seeking a zone change for a portion of the property located 1017
Union Street from Government & Institutional Service District (G&ISD) to
Shopping & Personal Service District (S&PS). The area requested to be changed
is shown in the exhibit in your packets.
2) The applicant is requesting this change in order to move parking spaces for their
business to this area due to the access road for Encompass's rehabilitation
hospital encroaching onto their existing parking area. They are working with the
owner of Encompass Health (the current owner of 1017 Union Street) to be
conveyed this land and have provided an email from Encompass Health giving
permission for this zone change, as well as a draft deed conveying the property.
3) The area around the property consists primarily of a mix of commercial and
institutional uses. The zoning around the property consists primarily of
Government & Institutional Service District (G&ISD) and Shopping & Personal
Service District (S&PS).

4) This area is within the growth boundary shown in the 2022 Comprehensive Plan
and the future land use map in the Plan shows this property in the Neighborhood
Residential area which consists of"medium-density residential development with
limited commercial and institutional uses that are complementary to the
surrounding residential land uses".
Planning Board members discussed the concern with the encroachment on the wetland.
The applicant indicated they are working with Maine DEP on the allowable
encroachment. Staff confirmed this work in progress.
Board members also asked about the setback for the parking along the side of the
Midas lot (subject property). Staff indicated this would be looked at for the site plan but
they can extend the non-conformity (parking setback) in that district.
By a motion duly made and seconded, the Board unanimously passed the
recommendation to the City Council that the zone change ought to pass.
