Good evening, My name is Scott Pardy, and I am here tonight to speak about an issue of vital im-
portance to our city's democratic process: the recent and drastic reduction in public comment time.
Several months ago, this council, or a previous iteration of it, made a decision to significantly cut the
time allocated for public comment, reducing it from a full hour at the beginning of the meeting to a
mere fifteen minutes, with the balance relegated to the end of agenda items. The stated rationale was
to prioritize comments specifically related to items on the evening's agenda, ensuring that those di-
rectly impacted by current decisions had ample opportunity to speak. While the intention may have
been noble, the practical outcome has been far different and deeply detrimental.
We have consistently observed that comments on agenda items are, more often than not, quite rare.
Yet, without fail,there is a consistent and robust desire from the public to speak on matters not on
the agenda. These are the issues that truly concern us, the everyday challenges and observations that
shape our lives in this city. These are the moments when we, the citizens, can directly bring our con-
cerns, our ideas, and our frustrations to our elected representatives.
Furthermore, moving public comment to the end of the agenda has created a significant barrier to
participation. It is now much more difficult to get people to come to these meetings. Residents feel
that their input is not truly wanted, and understanda.bly, few are willing to wait through an entire
agenda, often late into the evening,just for a brief opportunity to speak. This change has effectively
discouraged public engagement.
Moreover, a significant portion of city business is conducted in "executive session" or "secret ses-
sion." This lack of transpaxency, while sometimes legally necessary, unfortunately leaves the public
in the dark about many critical decisions and discussions. When so much is held behind closed
doors, the public comment period becomes an even more essential avenue for citizens to voice con-
cerns, seek clarity, and hold their government accountable. To disenfranchise the public by limiting
this crucial avenue for direct communication is, frankly, abhorrent to the principles of open govern-
ance.
This is not merely a suggestion; it is a public complaint and a fervent plea for this council to reverse
its position. Restore the public comment time to its previous length of one hour, and return it to the
beginning of the meeting, where it truly serves as a welcoming and accessible forum for citizen in-
put. Allow your constituents the full opportunity to engage with their government on all matters, not
just those you deem worthy of the agenda.
I am well awaxe that some of you sitting on this council tonight were not part of the body when this
decision was initially made. To you, I appeal to your commitment to public service and your dedica-
tion to democratic principles. You now have the opportunity to rectify a decision that has stifled
public participation and eroded trust.

I,would like to address the Waterfront Concert fence mural and paintings which have
recently been displayed.
These paintings were part of a proposed 3�d Amendment to the Lease with the Waterfront
concerts that was proposed at the Business and Economic Development Committee
meeting held on August 19, 2024. At this meeting,the city solicitor read the amendment to
the Lease. In this third Amendment to 114/19 Lease, it states that"Waterfront has agreed

At the Bangor City Council meeting held on August 26, 2024, Item no. 24-264 The Order
Authorizing the City Manager to Execute a Third Amendment to Lease with Watertront
Concerts, LLC to Finalize the Temporarily Expanded Lease Area was approved. In this
order, it again states that"Watertront has also agreed to coordinate with#he City's
Community and Economic Development Department to develop an appropriate and
aesthetically pleasing mural design to be painted or applied onto a substantial portion of
the length of Watertront's wooden fence that faces main Street at their expense.
...Waterfront has acknowledged and agreed that the finat mural design must be;reviewed,
and recommended by the;Commission on_Cultural Development, and finally�approved by
the City�Counc.il:;(enclosure#2).A motion was made to approve this item,the motion was
seconded for passage and it was approved. The minutes from the City Councilk meeting
held on August 26, 2024 were presented at the Bangor City Council September 9, 2024

At the April 4, 2025, Commission on Cultural Development meeting, Item#6 on the Agenda
was the Waterfront Concerts Fence Project presented by Bangor Beautiful(enclosure#4)

At this meeting,Annette Dodd from Bangor Beautiful presents the Watertront fence mural
proposal. According to the Bangor Beautiful Waterfront Concerts Fence Murals
information,"Each murat is being painted by a different Ilocal artist, being provided with a
primed 4'x4' marine plywood canvas, primary color exterior paint, and a$450 stipend:' At
this meeting,the Paintings had not been reviewed yet;yet Annette Dodd states that"20
artists are currently working on them".The theme of Maine is a broad theme, but the plan is
to have a website at the end where people can go and learn about the artist and why they

painted what they did about the theme of Maine. As of today,Juty 14, 2025,the murals are
on display; howeverthere is no information on the Bangor Beautifulwebsite regardingwho
the"local"artists are and what their explanation is regarding their paintings with a"Maine"
theme. At the Commission on cultural Development when Annette Dodd is talking about

the 20 artists, she says she probably;"jumped fhe gun a bit"and hired the 20(artists to paint

these 4'x4'paintings. In the paperwork for this meeting available online,there are only 2
examples of the 4'x4' paintings presented. These 2 paintings are ones which could be
considered somewhat related to Maine.
In the past,when the cultural commission makes decision regarding murals or paintings on
the public toilets,they are presented with drawings of the proposed paintings. Why were
no drawings presented prior to the approval of these murals? Why did Annette Dodd,
;"jump the�gun"and hire these artists prior to any approval by the cultural commission? In
Accordance with the amendment to the Lease with Waterfront Concerts which was
approved by the City Council at their August 26, 2024 meeting, it states in the Lease
Amendment that the paintings must be"appropriate,aesthetically pleasing"and must
be REVIEWED and recommended bythe Commission on Cultural Development, and
finally approved by the City Council:' The Development Director advised the Cultural
commission to make a motion regarding a decision on whether to approve the paintings so
that it could proceed to the Business and Economic Devetopment Committee. The
Cultural Commission then approved of the paintings so that it could proceed to the
Economic Development Committee. The Culturat Commission did not see atl the
paintings,there were 18 of the paintings that were not reviewed as required before the
recommendation according to the amendment to the Lease with Waterfront Concerts.
This is a vi'olation of a contract.The Chair of the Cultural commission at the

conclusion of the meeting states that she is excited to see all the individuat pictures.
She had not seen them yet; however,they were approved this is a violation of the tease
agreement.
At the Business and Economic Development Committee meeting held on Wednesday,April
23, 2025 (enclosure#5), Item#1 on the agenda was the Bangor Beautiful Fence Mural
Adjacent to Waterfront Concerts. In the memorandum from the Economic Development
Director, it states that"in the most recent lease agreement with Watertront Concerts,there

was a stipulation;thatthe muralwould be_reviewed bythe Council. The renderings

provided to the Economic Development Committee only contained 2 of the proposed 20

At the Bangor City Council meeting held on April 28th, 2025, (Enclosure#6) Item#25-145,
the ORDER,Approving a Mural on the Fence Along Main St. Enclosing the Waterfront
Concerts Leased Area was presented by Councilor Fournier. In this Order it states that the

The City Council voted to authorize Bangor Beautiful to undertake the execution of the
reviewed murat on the fence along Maine Street that encloses the Waterfront
Concerts teased area. They voted to authorize this without the review of 18 of the
paintings bythe Cultural Commission,the Economic Development Committee or the City
Council. This was a violation of the Contract.

If the City's Cultural Commission, Economic Development Committee and City Council
are all going to approve artwork without their review, as Required by the Amendment to the
Lease with Waterfront Concerts,then how are the taxpaying residents of Bangor supposed
to trust that they will honor any leases? This sets the dangerous precedent of approving
artwork to be placed anywhere in this city without the review of the appropriate
committees.
Some of this artwork is questionable (Enclosure#7) regarding its negativity and occult
symbolism. It is questionable how some of these paintings are representative of Maine.
The artist names and explanations are not on the Bangor Beautiful website. These .
paintings can be viewed by people who are visiting Bangor and standing in line waiting to
enter the concert area. They are in an area that homeless often travel between the
hometess shelter and Shaw's. Some of these paintings can be viewed as da.rk and
demoralizing.
These painting were approved by subverting the contract which required the review of the
cuttural commission and the city council. It was approved without a review of all 20
paintings in violation of the contract. I would suggest a member of the council make a
motion to rescind this previous decision to approve these paintings, or if this falls under a
Point of Order or a Parliamentary Inquiry,this should be made by a councilor to address
this procedural error. Since the councit made a decision in violation of a contract,
residents could call for an internal review and dispute resolution or could seek legal action
and sue for a breach of contract. Some of this artwork can be viewed as offensive and
demoralizing public displays of art.

Re: Waterfront Concerts —Third Amendment to 11/4/19 Lease
Staff has been working with Waterfront Concerts to finalize the expanded lease area that was
required to accommodate additional emergency egress required by the State Fire Marshall prior to the
2023 concert season.
As part of the review by the State Fire Marshall, it was found that additional emergency egress was
needed to accommodate a full venue of approximately 17,000 people. The Second Amendment to
11/4/19 Lease, executed in June 2023, established a temporary expanded lease area for this use,
with the understanding that the expanded lease area would be finalized when the construction of the
permanent steps to accommodate this secondary means of egress was completed.
The construction of the permanent steps has been completed, and the boundaries of the permanent
expanded lease area have been established and confirmed by the City's Engineering Department and
WaterFront Concerts staff.
In return for the additional leased area, Waterfront Concerts has agreed to allow the Citv use of
Waterfront's portable stage, of which the City has had a need since its own portable stage became
aqed and ultimate.ly_unusable. In addition to the agreed use of Waterfront's portable stage, Waterfront
has agreed to coordinate with the Community & Economic Development Department to develop an
�a ro riate aesthetically pleasing mural d si n to be painted or applied onto a substantial portion of
the length of Waterfront's woo en fence that faces Main Street, at Waterfront's expense. Waterfront
has agreed that the mural is to be completed by no later than the start of the 2025 concert season,
with the ability to seek an extension for good cause for the mural to be completed by no later than
June 15, 2025. WaterFront has acknowledged and agreed that the final mural desiqn mus be
�eviewed and recommended by the Commission_on Cultural Development, and finally approved by
`the City Council. ^V ----
The Third Amendment to the 11/4/19 Lease Agreement with Waterfront Concerts finalizes the
expanded leased area (28,838 additional square feet, as depicted in the attached Exhibit A) and
provides for the City's use of WaterFront's portable stage and for the agreed-upon development,
approval, and painting or application of an appropriate, aesthetically pleasing mural design on the
wooden fence, with the form of the lease amendment to be approved by the City Solicitor's office.

Cammittee on August 12, 2424. The Comrnittee has completed the process of interviewing applieants and
developed recommendations far fu11 Council considexation. This item was reviewed in executive session on
August 12,2024, and put forth for approval by the Personnel Committee.

working with Waterfront Concerts ta fmalize the expanded lease area that was required to accommadate
additional emergency egress required by the State Fire Marshall priar ta the 2023 concert season. As part of the
review by the State Fire Marshall, it was found that additional emergency egress was needed to accornmodate a
full venue of approximately 17,000 people. The second amendment to the Iease, executed in June 2023,
established a temparary expanded lease area for this use with the understanding that the expanded lease area
would be finalized when canstruction af the perrnanent steps was compieted ta aceommodate this secandary

The construction of the perxnanent steps has been completed, and the boundaries of the permanent expanded
lease area have been established and confirmed by the City's Engineering Department and Waterfront
Concerts staff. In return for this additional leased area, Waterfront has agreed to provide the City with use of
Waterfront's portable stage. The City has needed a portable stage since the City's portable stage aged and
became no longer usable.
Waterfront has also agreed to coordinate with the City's Community and Economic Development Department
� to develop an appropriate and aesthetically pleasing mural design to be painted or applied onto a substantial
portion of the lengt of Waterfront's wooden fence that faces Main Street at their expense. The mural is to be
completed no later than the start of the 2025 concert season. Waterfront has acknowledged and agreed that
� the final mural design must be reviewed and recommended by the Commission on Cultural Development, and
finally approved by the City Council. An extension for good cause of the deadline for completion of the��� �
mural may be requested and if approved,the mural must be completed no later than June 15, 2025.
This item was reviewed and recommended for approval by the Business and Economic Development
Committee on August 19, 2024.
24-265 ORDER Authorizing the Execution of a Non-Exclusive TREMSLE
Purchase Option for Development of a Veteran's
Affairs Community-Based Outpatient Clinic (CBOC)
at the Maine Business Enterprise Park
Egecutive Summary: This Order will authorize the City Manager to execute a Purchase Option Agreement
for six developers submitting bids to the United States Deparhnent of Veterans' Affairs (VA),to design and
lease a 75,000 square foot outpatient clinic.
The Purchase Option shall be non-exclusive, allowing each developer an open competitive advantage to a VA
award. These documents also bind the City to sell the property to the VA Awardee, should the VA select the
subject parcel(s), for the stated purposes in the Agreement.
The terms and conditions contained in the Agreement shall pertain to the eventual Purchase and Sale Contract
and will include the following:
1. That the Property remain taxable in perpetuity or, in the event the property is sold to a tax-exempt entity, a
100%payment in lieu of taxes will be required;
2. That the development of the parcels remain true to the stated purposes in the VA Award;
3. The parcel configuration will be in an acceptable form to the City;
4. The Developer shall be responsible for all feasibility studies, including any traffic studies, environmental
assessments, hard and soft costs related to the facility; and
5. The existing Deed Restrictions and Covenants shall survive the sale of the property.
The Purchase Option will open negotiations with an Initial Option fee, and upon exercise, an Additional
Option Fee. The purchase price shall be $90,000 per acre. This item was reviewed and recommended for
passage at the Business and Economic Development Corrunittee meeting on August 19, 2024.

LAND DEVELOPMENT CODE, Action requested to make a
recommendation to move forward
Planning Officer Anja Collette presented to the Committee and gave overview of
proposed changes and State law LD 337.
Councilor Leonard asked about proposed roofing requirements and whether these
would conflict with materials used in 3D-printed homes— Planning Officer Collette
responded that she would look into this.
Councilor Schaefer expressed support for the proposed changes.
Councilor Schaefer moved recommendation to move forward, seconded by .

2. AIRPORT DIRECTOR'S REPORT
Airport Director Jose Saavedra presented to the Committee and gave report on �
ongoing construction projects, Brownfields project, passenger traffic numbers,
staff's participation at the Farnborough Air Show, recent visit from United Airlines,
community engagement activities, Honor Flight Maine, and yearly compliance
inspection.
Councilor Schaefer expressed support for the Honor Flight coordination.

CONCERTS,Action requested to make a recommendation to move forward
City Solicitor David Szewczyk presented to the Committee and gave overview of
proposed lease amendment.
Councilor Tremble expressed a desire to have a set cost that WaterFront Concerts
� will agree to pay, rather than leaving this open-ended. City Solicitor Szewczyk
clarified conversations that have already occurred between WaterFront Concerts
and staff, and the plan moving forward.
Chair Hawes expressed support for the mural project, but mentioned some
concerns about the fence.
Councilor Leonard moved recommendation to move forward, seconded by
Councilor Schaefer. Vote unless doubted, no doubt.

I. introduction
The City of Bangor (City) Commission on Cultural Development is seeking proposals from
qualified artists to design and create murals for two (2) public restrooms that are installed
across the City. The murals will improve the appearance of the bathrooms, create a positive
public image for these community projects, and showcase the work of local artists. The City
will provide the plywood or similar materials that will be used as the mural canvas. All
materials used must withstand severe weather conditions.
II. General Information
Available at the following web address: www.bangormaine.qov/proposals on the City's
website. By submitting a response to this solicitation, the Proposer accepts the responsibility
for downloading, reading, and bidding by the terms and conditions set forth in the City's
"General Information for Vendors."
In your proposal, please specify whether you currently have, or are in the process of
developing, a domestic violence policy. If you do not have such a policy, let us know if you
would like to receive a copy of the City of Bangor's policy as a reference.

opening date. Visit www.banqormaine.qov/bids for results. The "Show
Closed/Awarded/Cancelled Bids" box must be checked to see the proposal information.
IV. Questions
Any questions must be directed in writing to bids _bangormaine.qov no later than 4:30 P.M.,
Friday, March 21, 2025.
The City will provide a response by 4:30 P.M. on Friday, March 28, 2025. This response will
be in the form of an addendum, accessible on the City's website. Notifications will be sent to
. those who have signed up to receive notifications at www.bangormaine.gov/bids through
NotifyME. Notifications will be sent when new addenda are released.
V. Late Proposals
It is the responsibility of the Proposer(s) to see that their proposals have sufficient time to be
received by the Purchasing Department before the submittal deadline. Any proposal, portion
of a proposal, or requested proposal revision received at the City Purchasing Department
after the time and date specified will be returned to the Proposer unopened or, if by electronic
submission, deleted without being opened.
VI. Withdrawal of Proposals
No Proposer may withdraw their proposal for a period of ninety (90) days from the date of
opening. All proposals shall be subject to acceptance by the City during this period.
To withdraw a proposal prior to the opening, the Proposer shall request'the withdrawal in
writing. All costs associated with the withdrawal (i.e., mailing fees) will be borne by the
Proposer.
VII. Rejection
The City reserves the right to reject any proposals, waive any informalities or defects in
proposals, or accept a higher-cost proposal if it is deemed to be in the best interest of the
City. The City also reserves the right to request clarification of any details from the successful ,
Proposer.

VIII. Information for Proposers
A. Tax Exclusion: All Federal and State taxes must be excluded from the proposal price.
Upon request, a tax exemption certificate for the City of Bangor shall be furnished to
the successful Proposer.
B. Bid Form: Must be completed and returned with the proposal to be considered
responsive.
C. Citv Responsibilitv: The City will be provided the canvas material to be painted. The
City is also responsible for the installation of both completed canvases.
IX. Bangor Commission on Cultural Development (CCD)
The City of Bangor Commission on Cultural Development (CCD) supports arts and culture in
Bangor, Maine, through funding, marketing advocacy, and education to benefit citizens,
visitors, and the economic and cultural vitality of the City. The CCD has authorization to
assess the City's needs, develop and maintain a comprehensive arts and cultural policy,
review grant applications and public art requests, and work with the community to identify
and encourage opportunities for the incubation of promising arts and cultural enterprises.
The CCD accepts grant applications from individual artists and non-profit arts and cultural
organizations twice per year (grant deadlines are April 1St and October 1St). For more

X. Scope of Services
The City is requesting an artist or group of artists to design and execute murals for two (2)
public restrooms that are installed in Bangor. The City will handle final installation of the
murals. The following are the scope of services:
A. Murals will be on plywood or a similar material to be provided by the City. The CCD
and City will work with the selected Proposer(s)to determine what material will be best
for the project.
B. Murals are to be painted in the successful Proposer(s) studio and shall be protected
with varnish that can withstand severe weather conditions.
C. Restroom 1 is located on Harlow Street near the Bangor Public Library, and Restroom
2 is located on Broad Street near the Waterfront.
D. Each restroom has available space for the proposed artwork as follows:
1. Two (2) side panels — 108 in. (9 ft) long x 78 in. (6.5 ft) high
2. One (1) back panel — 72 in. (6 ft) long x 50 in. (4 ft) high
E. Proposer(s) will be encouraged, but not required, to participate in at least one (1)
associated program and/or artist talk in the two (2) months following the final
installation.

XI. Review and Timeline
The CCD will be notifying the Proposer(s) of the award in April 2025. Members of the CCD
will work with the selected Proposer(s) to refine the project to ensure successful
implementation. Special consideration will be given to murals with subject matter and themes
that are inspired by the restrooms' locations as well as Bangor's community and history. This
project is open to all Proposers of any age, race, color, religion, national origin, gender, age,
military status, sexual orientation, marital status, or physical disability. Students are eligible
to submit proposals. Murals shall be completed by June 30, 2025, for installation in July
2025. A change in the timeline must be approved by the City. Proposals will be reviewed by
the CCD based on the following:
A. Overall quality of the proposal
B. Project feasibility within the provided budget and timeline
C. Artistic ability
D. Visual impact
E. Theme relevance
XII. Proposal Requirements
The proposal should include:
A. One to two - ' d drawings or digital sketches of the proposed work.
B. Letter of interest (no longer than two (2) pages : _

and the total file size should not exceed 2 MB.

E. The selected Proposer(s) will receive a $2,400 honorarium ($1,200 per restroom) in
addition to a material reimbursement (excludes canvas material that will be provided
by the City). Proposer(s) must provide materials pricing on the Bid Form.

The remaining 685 feet of fence were stained in a repeating, cohesive, color block
pattern with a 4 foot by 4 foot mural every 20 feet. Each mural was being painted by a
different local artist, bringing an incredible diversity of artists and visions on the
subject of Maine. Each artist was being provided with a primed 4'x4' marine plywood
canvas, primary color exterior paint, and a �450 stipend. The murals were be sealed
and installed in June 2025. This project has potential to add more artist works as time
goes on, so stay tuned!

Please accept this memorandum as background information on the above-noted
agenda item.
Bangor Beautiful approached City staff to place murals on the Waterfront Concerts
fence along Main Street. Bangor Beautiful met with Waterfront Concerts for initial
approval and was then directed to City staff. As the subject property is not located within
the Bangor Center Revitalization Area, staff advised Bangor Beautiful that they would
need to appear before the Commission on Cultural Development to review the project;
this presentation was made at their April meeting. The Commission passed a motion to
recommend the placement of these murals.
The Commission on Cultural Development (often referred to as Cultural Commission) is
an 11-member commission appointed by the City Council, 4 members of which are in
the arts & humanities fields. Their mission is to promote the development of Bangor as
a regional arts center that nurtures the artistic and cultural expression of its diverse
peop/es (see Chapter 23 of the City Code.) Their work is legislated by Chapter 95 of
the City Code, and notably for this item, Chapter 260 — Signs. Murals are exempt from
signage requirements upon review by the Commission. The Commission then makes
their recommendation to the City Council, as noted above. The City Council is the final
authority on murals or any art piece on public property.

Waterfront Concerts Fence Murals
April 4, 2025
Bangor Beautiful and WaterFront Concerts are pleased to present the Waterfront Concerts
Fence Murals, a 760 foot series of murals along Main Street. We are collaborating with
Jared Goulette aka The Color Wizard and 20 local artists to fill the long wooden fence in
front of the Maine Savings Amphitheatre with murals on the theme of'Maine.'
The largest mural will be painted by�ared Goulette on the first 75 foot section directly in
front of the stage. It has been commissioned by Waterfront Concerts to target the
thousands of concert goers who visit Main Street by depicting the words "We hope you
have a Wicked Good Time" in a vintage postcard style. The background and inside of the
letters will be filled with images of central Maine landscapes, such as lakes and mountains.
The mural will be painted over two days in June 2025.

Planning Fees Starting July 1,2025
Executive Summary: This Order will amend the City's Schedule of Fees to change the fees charged for
Planning services beginning July l, 2025.
Currently, land development and zoning fees are not reflective of the staff time spent on applications
and the tiered structure of some fees based on square footage of disturbance or parcel area is not
relevant since similar amounts of staff time are generally spent on applications regardless of these
factors. High processing fees can be a barrier for development,particularly for small-scale developers,
and may add to the high cost of housing since development fees are typically included in the end sale or
rental price.
The Planning advertising fees are also out of aligrunent with what the City is currently charged by the
Bangor Daily News and the City has not been charging for Site Location of Development(SLODA)
adyertising fees even though advertising is necessary for new SLODA applications and major
modifications.
Th:e new fee changes proposed would rectify these misalignments. This item was reviewed and
recommended by the Business and Economic Development Committee meeting on April 23, 2025.
