Several months ago, this council, or a previous iteration of it, made a decision to significantly cut the time allocated for public comment, reducing it from a full hour at the beginning of the meeting to a mere fifteen minutes, with the balance relegated to the end of agenda items. The stated rationale was to prioritize comments specifically related to items on the evening's agenda, ensuring that those di- rectly impacted by current decisions had ample opportunity to speak. While the intention may have been noble, the practical outcome has been far different and deeply detrimental. We have consistently observed that comments on agenda items are, more often than not, quite rare. Yet, without fail,there is a consistent and robust desire from the public to speak on matters not on the agenda. These are the issues that truly concern us, the everyday challenges and observations that shape our lives in this city. These are the moments when we, the citizens, can directly bring our con- cerns, our ideas, and our frustrations to our elected representatives. Furthermore, moving public comment to the end of the agenda has created a significant barrier to participation. It is now much more difficult to get people to come to these meetings. Residents feel that their input is not truly wanted, and understanda.bly, few are willing to wait through an entire agenda, often late into the evening,just for a brief opportunity to speak. This change has effectively discouraged public engagement. Moreover, a significant portion of city business is conducted in "executive session" or "secret ses- sion." This lack of transpaxency, while sometimes legally necessary, unfortunately leaves the public in the dark about many critical decisions and discussions. When so much is held behind closed doors, the public comment period becomes an even more essential avenue for citizens to voice con- cerns, seek clarity, and hold their government accountable. To disenfranchise the public by limiting this crucial avenue for direct communication is, frankly, abhorrent to the principles of open govern- ance. This is not merely a suggestion; it is a public complaint and a fervent plea for this council to reverse its position. Restore the public comment time to its previous length of one hour, and return it to the beginning of the meeting, where it truly serves as a welcoming and accessible forum for citizen in- put. Allow your constituents the full opportunity to engage with their government on all matters, not just those you deem worthy of the agenda. I am well awaxe that some of you sitting on this council tonight were not part of the body when this decision was initially made. To you, I appeal to your commitment to public service and your dedica- tion to democratic principles. These paintings were part of a proposed 3�d Amendment to the Lease with the Waterfront concerts that was proposed at the Business and Economic Development Committee meeting held on August 19, 2024. At this meeting,the city solicitor read the amendment to the Lease. Commi�ss�ion on#�Cuttural Development, and finally approved by the City�Council!" �___,_.. ill_.__ .�. �....._'.�.'. � (Enclosure#1, page 2) At the Bangor City Council meeting held on August 26, 2024, Item no. 24-264 The Order Authorizing the City Manager to Execute a Third Amendment to Lease with Watertront Concerts, LLC to Finalize the Temporarily Expanded Lease Area was approved. In this order, it again states that"Watertront has also agreed to coordinate with#he City's Community and Economic Development Department to develop an appropriate and aesthetically pleasing mural design to be painted or applied onto a substantial portion of the length of Watertront's wooden fence that faces main Street at their expense. ...Waterfront has acknowledged and agreed that the finat mural design must be;reviewed, and recommended by the;Commission on_Cultural Development, and finally�approved by the City�Counc.il:;(enclosure#2).A motion was made to approve this item,the motion was seconded for passage and it was approved. The minutes from the City Councilk meeting held on August 26, 2024 were presented at the Bangor City Council September 9, 2024 meeting. According to the Bangor Beautiful Waterfront Concerts Fence Murals information,"Each murat is being painted by a different Ilocal artist, being provided with a primed 4'x4' marine plywood canvas, primary color exterior paint, and a$450 stipend:' At this meeting,the Paintings had not been reviewed yet;yet Annette Dodd states that"20 artists are currently working on them".The theme of Maine is a broad theme, but the plan is to have a website at the end where people can go and learn about the artist and why they l i painted what they did about the theme of Maine. As of today,Juty 14, 2025,the murals are on display; howeverthere is no information on the Bangor Beautifulwebsite regardingwho the"local"artists are and what their explanation is regarding their paintings with a"Maine" theme. At the Commission on cultural Development when Annette Dodd is talking about -- ----------- �- ---- - --�__;r--- -_. the 20 artists, she says she probably;"jumped fhe gun a bit"and hired the 20(artists to paint __---._. �--- ----��--- - � these 4'x4'paintings. In the paperwork for this meeting available online,there are only 2 examples of the 4'x4' paintings presented. These 2 paintings are ones which could be considered somewhat related to Maine. In the past,when the cultural commission makes decision regarding murals or paintings on the public toilets,they are presented with drawings of the proposed paintings. Why were no drawings presented prior to the approval of these murals? Why did Annette Dodd, ;"jump the�gun"and hire these artists prior to any approval by the cultural commission? In Accordance with the amendment to the Lease with Waterfront Concerts which was approved by the City Council at their August 26, 2024 meeting, it states in the Lease Amendment that the paintings must be"appropriate,aesthetically pleasing"and must be REVIEWED and recommended bythe Commission on Cultural Development, and finally approved by the City Council:' The Development Director advised the Cultural commission to make a motion regarding a decision on whether to approve the paintings so that it could proceed to the Business and Economic Devetopment Committee. The Cultural Commission then approved of the paintings so that it could proceed to the Economic Development Committee. The Culturat Commission did not see atl the paintings,there were 18 of the paintings that were not reviewed as required before the recommendation according to the amendment to the Lease with Waterfront Concerts. This is a vi'olation of a contract.The Chair of the Cultural commission at the =---�-�--.,_....-,-.-_�----�---- -- - ---- conclusion of the meeting states that she is excited to see all the individuat pictures. She had not seen them yet; however,they were approved this is a violation of the tease agreement. At the Business and Economic Development Committee meeting held on Wednesday,April 23, 2025 (enclosure#5), Item#1 on the agenda was the Bangor Beautiful Fence Mural Adjacent to Waterfront Concerts. In the memorandum from the Economic Development Director, it states that"in the most recent lease agreement with Watertront Concerts,there ��--,��T-_-�._�.�------- ----------.__-----------------�---�_---------,-„ was a stipulation;thatthe muralwould be_reviewed bythe Council. The renderings .�__ provided to the Economic Development Committee only contained 2 of the proposed 20 paintings. They voted to authorize this without the review of 18 of the paintings bythe Cultural Commission,the Economic Development Committee or the City Council. This was a violation of the Contract. This sets the dangerous precedent of approving artwork to be placed anywhere in this city without the review of the appropriate committees. Some of this artwork is questionable (Enclosure#7) regarding its negativity and occult symbolism. It is questionable how some of these paintings are representative of Maine. The artist names and explanations are not on the Bangor Beautiful website. These . paintings can be viewed by people who are visiting Bangor and standing in line waiting to enter the concert area. They are in an area that homeless often travel between the hometess shelter and Shaw's. Some of these paintings can be viewed as da.rk and demoralizing. These painting were approved by subverting the contract which required the review of the cuttural commission and the city council. It was approved without a review of all 20 paintings in violation of the contract. I would suggest a member of the council make a motion to rescind this previous decision to approve these paintings, or if this falls under a Point of Order or a Parliamentary Inquiry,this should be made by a councilor to address this procedural error. Since the councit made a decision in violation of a contract, residents could call for an internal review and dispute resolution or could seek legal action and sue for a breach of contract. Some of this artwork can be viewed as offensive and demoralizing public displays of art. As part of the review by the State Fire Marshall, it was found that additional emergency egress was needed to accommodate a full venue of approximately 17,000 people. The Second Amendment to 11/4/19 Lease, executed in June 2023, established a temporary expanded lease area for this use, with the understanding that the expanded lease area would be finalized when the construction of the permanent steps to accommodate this secondary means of egress was completed. The construction of the permanent steps has been completed, and the boundaries of the permanent expanded lease area have been established and confirmed by the City's Engineering Department and WaterFront Concerts staff. In return for the additional leased area, Waterfront Concerts has agreed to allow the Citv use of Waterfront's portable stage, of which the City has had a need since its own portable stage became aqed and ultimate.ly_unusable. In addition to the agreed use of Waterfront's portable stage, Waterfront has agreed to coordinate with the Community & Economic Development Department to develop an �a ro riate aesthetically pleasing mural d si n to be painted or applied onto a substantial portion of the length of Waterfront's woo en fence that faces Main Street, at Waterfront's expense. Waterfront has agreed that the mural is to be completed by no later than the start of the 2025 concert season, with the ability to seek an extension for good cause for the mural to be completed by no later than June 15, 2025. WaterFront has acknowledged and agreed that the final mural desiqn mus be �eviewed and recommended by the Commission_on Cultural Development, and finally approved by `the City Council. ^V ---- The Third Amendment to the 11/4/19 Lease Agreement with Waterfront Concerts finalizes the expanded leased area (28,838 additional square feet, as depicted in the attached Exhibit A) and provides for the City's use of WaterFront's portable stage and for the agreed-upon development, approval, and painting or application of an appropriate, aesthetically pleasing mural design on the wooden fence, with the form of the lease amendment to be approved by the City Solicitor's office. The murals will improve the appearance of the bathrooms, create a positive public image for these community projects, and showcase the work of local artists. Scope of Services The City is requesting an artist or group of artists to design and execute murals for two (2) public restrooms that are installed in Bangor. The City will handle final installation of the murals. The following are the scope of services: A. Murals will be on plywood or a similar material to be provided by the City. The CCD and City will work with the selected Proposer(s)to determine what material will be best for the project. B. Murals are to be painted in the successful Proposer(s) studio and shall be protected with varnish that can withstand severe weather conditions. C. Restroom 1 is located on Harlow Street near the Bangor Public Library, and Restroom 2 is located on Broad Street near the Waterfront. D. Bangor Beautiful met with Waterfront Concerts for initial approval and was then directed to City staff. As the subject property is not located within the Bangor Center Revitalization Area, staff advised Bangor Beautiful that they would need to appear before the Commission on Cultural Development to review the project; this presentation was made at their April meeting. The Commission passed a motion to recommend the placement of these murals. The Commission on Cultural Development (often referred to as Cultural Commission) is an 11-member commission appointed by the City Council, 4 members of which are in the arts & humanities fields. Their mission is to promote the development of Bangor as a regional arts center that nurtures the artistic and cultural expression of its diverse peop/es (see Chapter 23 of the City Code.) Their work is legislated by Chapter 95 of the City Code, and notably for this item, Chapter 260 — Signs. Murals are exempt from signage requirements upon review by the Commission. The Commission then makes their recommendation to the City Council, as noted above. We are collaborating with Jared Goulette aka The Color Wizard and 20 local artists to fill the long wooden fence in front of the Maine Savings Amphitheatre with murals on the theme of'Maine.' It has been commissioned by Waterfront Concerts to target the thousands of concert goers who visit Main Street by depicting the words "We hope you have a Wicked Good Time" in a vintage postcard style. High processing fees can be a barrier for development,particularly for small-scale developers, and may add to the high cost of housing since development fees are typically included in the end sale or rental price.
