PENOBSCOT ROOM, LOWER FLOOR OF PENQUIS CAP 262 HARLOW STREET MEETING MINUTES Board Members Present: Chair Reese Perkins Vice Chair Jonathan Boucher Michael Bazinet Ted Brush Trish Hayes Ken Huhn Janet Sanborn Jonas City Staff Present: Anja Collette, Planning Officer David Szewczyk, City Solicitor Chair Perkins called the meeting to order at 7:01 P.M. OLD BUSINESS 1. Meeting Minutes — May 6, 2025 Member Huhn moved to approve the minutes of May 6, 2025, seconded by Member Bazinet. Member Hayes noted a clerical error in the meeting minutes regarding the date. Motion amended to reflect this correction. Roll call vote conducted —all voting members in favor, none opposed. Motion passed. 2. Adoption of Revised Findings & Decision for 154 Sunset Avenue Chair Perkins clarified the revisions that were made. Vice Chair Boucher moved to adopt the revised Findings & Decision for 154 Sunset Avenue, seconded by Member Jonas. Roll call vote conducted — all voting members in favor, none opposed. Motion passed. CHAIR INTRODUCTION Chair Perkins made his introduction. To amend the Land Development Code by adding a general public safety use to the Airport Development District (ADD). Planning Officer Anja Collette gave an overview of the proposed amendment. Chair Perkins asked the Board for any questions or comments —there were none. Chair Perkins opened the public comments —there were none. Public comments closed. Member Huhn moved that the Board recommend to City Council that the proposal to amend the Land Development Code by adding a general public safety use to the Airport Development District (ADD) ought to pass. Seconded by Member Brush. Roll call vote conducted — all in favor, none opposed. Motion passed. 4. To amend the Land Development Code by providing additional clarification on requirements for land development permits. Planning Officer Anja Collette gave an overview of the proposed amendment. Chair Perkins asked the Board for any questions or comments. Vice Chair Boucher asked if a new land development application would prompt a review of the applicant's other properties to determine if there were code violations. Planning Officer Collette clarified that it would only involve searching to see if there were outstanding official notices of violation, which are documented on paper. It wouldn't involve a review to find code violations that were not known about previously and that had no official notice of violation. Vice Chair Boucher asked how LLC's would be handled for the land development code violations. Collette stated that the current submission requirements for land development applications require a list of owners in the company or entity if it is something like an LLC that is an applicant. Staff could then look to see if the owners of the LLC had any outstanding violations. This process would be similar to how ownership documentation for short-term rental applications is reviewed to determine compliance with those regulations. Boucher asked for confirmation that if a member of the LLC had outstanding violations, that the LLC then couldn't move forward with the new land development permit. Collette confirmed that would be the case. Chair Perkins asked if this would only apply to cases where notices of violation were issued after the ordinance passage. City Solicitor Szewczyk clarified that the process would be if someone applies for an application after this ordinance goes into effect, it would trigger a review for any outstanding notices of violation, regardless of when those notices of violation were issued. Chair Perkins opened the public comments —there were none. Public comments closed. Vice Chair Boucher moved that the Board recommend to City Council that the proposal to amend the Land Development Code by providing additional clarification on requirements for land development permits ought to pass. Seconded by Member Bazinet. Roll call vote conducted — all in favor, none opposed. Motion passed. Follow Up on Thouqhts on Land Development Code/Land Use Plan Chair Perkins introduced the agenda item and asked about a recent request for public comment on CDBG funding. Planning Officer Anja Collette provided additional information regarding the CDBG Action Plan. Meeting adjourned at 7:19 pm.
