Amending the Code of Ordinances to Expand the Ability for Consent Agreements to be Used for City Code
Violations.
Summary
This language would amend the City's Code of Ordinances to expand the ability to use consent agreements to
address violations of the Code. Currently, this avenue is allowed for violations of the vacant properties
ordinance, but is not included in other ordinances, such as land development, historic preservation, and short-
term rentals. This type of allowance is useful because it provides the City with another avenue for enforcement
of code violations before having to go through the court system. Relying on court actions alone creates a
greater administrative burden and is very time-consuming, creating barriers to enforcement of the Code. Many
other communities have this type of allowance, such as Bar Harbor, Boothbay, and Ellsworth. A majority of the
Business & Economic Development Committee voted on March 3, 2025 to recommend this ordinance change.

ORDINANCE, Amending the Code of Ordinances to Expand the Ability for Consent Agreements to be Used for
Various Code Violations.
WHEREAS, at present, this avenue for code enforcement is allowed for violations of the vacant properties
ordinance, but is not included in other ordinances, such as land development, historic preservation, and short-
term rentals;
WHEREAS, this type of allowance is useful because it provides the City with another avenue for enforcement
of code violations before having to go through the court system, reducing administrative burdens;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR AS FOLLOWS, THAT
