The maximum speed limits for trucks on any town or city way will be 25 rnph (40 km per hour} unless a higher legal limit is specifically agreed upon in writing by the Municipal Of�cers concerned. 25-077 FEBRUARY 24,2025 GENERAL GUIDANCE CONSTRUCTION OVERL�MrT PERM�T AND BONDING The Maine Bureau of Motor Vehicles (BMV} establishes requirernents and standards for the permitting of non-divisible o�er dimensional and overweibht vehicles and loads {collectively o�erlirr�it loads} on state roads. These state motar vehicle permits are availabte on-line. 29-A MRSA and Secretary of State Administrative Rufes Chapters I55-157 apply. Additianally, municipalities and county cotnmissioners tnay issue overweight permits for traveI on municipal and county ways maintained by that znunicipality ar county. These permits are typically single trip permits requiring vehicle registration data, intended route etc. IIowever, in this case we're dealing with Canstructian Pernrits in�olving o�erlimit loads in support of construction projects. According to 29-A MRSA � 2382 (7}, a Construction Permit is a permit `for a stated pet�iod of trme that rnay be issuec�for loads and equiprnent employed on public way canstruction projects, Unzted States Gove��nment p��ojects ar construction of private v��ays, when within construction areas established by the Department of Transpartation". Fre uentl Ask�d uestions: A. Wh si n the document in advance of the actual construction contract? Response: There are three primary reasons: First, to comply with 29-A § 2382. Secand, to ensure that there are no surprises regarding the use of municipal roads by the Maine DOT cantractor (to reasonably reduce risk and thus keep the cost of construction down} and third, to ensure the town is aware af its rights to control its owrt roads, and its rights to require a separa�e contractor's bond. (This is in addition to the Payrr�ent Bond and the Performance Bond the Maine DOT requires of the contractor). B. Different roads rna re uire different levels of scrutin . How is a osted road handled? Response: Despite the general constructian overweight permit, the cantractar cannot exceed the load Iimit on a posted municipal road without speci�c municipai pe�•mission. 29-A � 2395 MRSA notes that any ways requiring special pratecfion (such as posted roads} will continue to be protected and overweight permits are superseded by such pastings. Is there any reason why t�e contR�actor cannot be held to inderalnify and ho[d harrnless the Municipality beyo_nd the simple posting of a bond? Response: The objective of our standard Iett�r is to deal with overweight equipmen� and trucks on municipal ways d�ring construction af a Maine DQT construction project. The bond rrierely provides a measure of protection against damage to rnur�icipal ways as a direct result of constructian activity. Other areas of risk and indemnificatian are beyand the scope af our lettez'. D. Are we reauirec�ta obtain a bond? Response: No. In fact, few municipalities have required a canstructian bond. It is a matter of risk management. E._ If used, what amount should be required on the bond? Resqonse: Previous MDOT letters used to speak about a maximum bond amount af$14,OQ0 / mile ($9,040 / kilameter ) of traveled length, however 29-A § 2382 sets no maximum. The arnount of the bond (if any 6ond is required at all} is based on the individual situatioi�. Tl�e MDOT will assist in prnviditig a bond atnounL estin�ate if st� requested. F. Wh,y the blanket appra�al? R.esponse: The blanket approval we seek is tlae reasonable accorr�modation by the municipality �o allaw the Maine DOT contractor to use town ways {if required ) ta haul overweight construction equipment and trucks. This theoreticalIy gives the municipality and the MDOT time to disc�ss exceptions to a blanket approval. in general, this avaids unnecessary risks and sa�es inoney fo�•all conce�ned in the long run. G. Who determines the suitabiIi of re airs? Response: �oc municipal ways, the suitability af repairs �may be determined by municipal of�cers. The MDOT will assist. H. What is a non-di�isible foad? Respanse: Per Chapter 157 {The Administration of Over-Dimension and Overweight Permits) under the Secretary of State administrative rules (See Rule Chapters for the Depa►-tment of the Secretary of State on line), a non-divisible load is defined as: A load which, if separated into smalIer ioads or vehicles, r�vouId: 1} make it unable to perform the function for which it was intended; 2) destroy its value oz-; 3) require znore than eight wark hours ta disrnantle using appropriate equipmenC. Sealed oceangoing containers, spent nuclear rr�aterials in casks, and gavernment-coiltrolled rnilitary vehicles and their lnads will be considered non-divisible Page 2 of 3 25-077 FEBRUARY 24,2025 I. What is the standard for Overwei�ht trucks and equipment? Respanse: Overweight rt�eans a weight that exceeds the legal limits estabIished an 29-A MRSA Chapter 21. ,�. This is an unor anized townshi with no count or zraunici al roads. WI� should I respand? Response: Because of limited staff, we send o�at a standard letter to cover contingencies and minimize risk to the constructinn process. From time to time the letter may not have a practical application. In most cases of unorganized territories, the agreement is signed and returned as a matter of routine. This ensures that su�•p��zses will not be �ncauntered after the start of construction regarding travel aver municipal and county ways. Additional tips: False Information - Permit are invalidated by false information. A permit is invalidated by the �iolation of any candition specified by the terms of the permit or by false znformation given on tY�e application. 4n evidence of such violatian of falsi�cation, the permittee may be denied additiona[ permits. Prope_r___Re,�istration - 4vez•load permits do nat relieve the registrants of vehicles firom their obligations to properly register their vehicles in aceordance with Motor Vehicle Laws. A�ent's Power of Attornev - If you da require a contractar's bond, ma[ce sure you have a copy of`tk�e Surety Agent's power of attoz-ney authorizing the surety agent to sign for the surety. Keep the power af attorney with your duplicate original bond at the tnunicipaIity. The contractor will also ha�ve a duplicate original. Other bonds - The Maine DOT requires a payment bond and a performance bond of the carnractor which is hefd against �nsatisfactory performance on the part af the contractar for all construction projects over ��aa,000. (The MiIler Act (40 U.S.C. 270a-270� normally requires perforrriance and payment bonds for any federal aid construction contract exceeding $100,000. 1Q� MRSA § 871 provides a simiIar requirer�tent for state funded construction projects.) These bonds cover the proper performance of the corttract and the payment of a(1 employees, suppliers and subcontractors. Overlim�t movemen# permits issued by State. The Secretary of State, acting under guidelines an.d advice of the Commissioner of Transportatian, may grant perznits to move nondivisible objects having a length, width, height or weight greater than specified in this Title over a way or 6ridge rnaintained by the Department af Transportation 2. Permit fee. The Secretary of State, with the advice of tYte Commissioner of Transpo�ation, may set the fee for single trip permits, at no# less than $6, nor more than $30, based on weight, height, length and width. The Secretary af State may, by rule, irr�plement fees that have be�n set by the Commissianer of Transportation for tnultiple trip, Iang-term overweight movement permits. Rules esTablished pursuant to this sectian are ro�tine technical rules pursuant to Title 5, chapter 375, subchapter II-A. 3. County and municipa� permits. A ca�nty cornmissioner or municipal a�ficer may grant a permit, for a reasonable fee, for tra�vel ov�r a way or bridge maintained by that county or municipality 4. Permits for fveig�t. A vehicle granted a permit for excess weight must �rst be registered for the maximum gross vehicle weight alIowed for that vehicle. S. Special mobile equipment. The Secretary of State may grant a permi�, for na more than one year, to move pneumatic-tire equipment under its own por�ver, including Class A and Class B special mobile eyuipment, over ways and b�•idges maintained by the Depar[ment af Transportatian. The fee for that permit is $15 for each 30-day period. 6. Scope of permit. A permit is limited to the particular vehicIe or object to be moved, the trailer or semitrailer hauling the overlimit object and particular ways and bridges. 7. Constr�ction permits. A permit for a stated period of time may be issued for loads and equipment emplayed an public way construction projects, United �tates Gavernment projects or construction of private ways, when within constructian areas estabIished by the Department ot'Transportation. The permit: A. Must be proc�red from the municipal officers for a construction area within that rnunicipality; B. May require the contractor to be responsible for damage to ways used in the construction areas and may provide far: (1) Withholding by �he agency contractin� the work of final payment under contract; or Page I of 3 25-077 FEBRUARY 24,2025 December 1 Q, 2004 Supercedes February 7, 1996 (2) The furnishing of a bond by the contractor to guarantee suitable repair or payment af damages. The suitability of repairs ar the amount of damagc is to be determined by the Department of Transportation on sfate-maintained ways and bridges, otherwise by the municipal officers; C. May be granted by the DeparCment of Transpartation or by the state engineer in charge of the construction contract; and D. For construction areas, carries no fee and does �7ot coine within the scope of t�is section. S. Gross vehicle weight permits. The following may grant permits to operate a �ehicle having a gross vehicle weight exceeding the prescribed litnifi: A. The Secretary of State, with the consent of the Department af Transportatian, for state and state aid highways and bridges within city oz-conrtpact village limits; B. Municipal officers, for alI other ways and bridges within that city and corr�pact village limits; and C. The county commissianers, foz county roads and bridges located in unorganized territory. 9. Pilot vehicles. The following restrictions apply to pilat�ehicles. A. Pilot �ehicles required by a permit must be equipped with warning Iights and signs as required by the Secretary of State with the advice of the Depar�ment of Transportation. B. Warning lights may be operated and lettering on tk�e signs may be visible on a pilot v�hicle only while it is escorting a vehicle with a permit on a public way. With the advice of the Commissioner of Transportation and the Chief of the State Police, the Secretary af State shall establish rules far the operation of pilot�ehicles. 9-A. Police eseorf. A person may not operate a single vehicle or a connbination of vehicles of I25 feet or more in length or 16 feet or more in width on a public way unless the vehicIe or combination of�ehicles is accompanied by a palice escort. The Secretary of State, with the advice of the Commissioner of Transportation, may require a police escort for vehicles of less�r dimensions. The Bureau of State Police shall establish a fee for state police escorts to defray the costs af providing a police escoi�t. A county sheriff or municipal police department may establish a fee to defray tk�e casts of providing police escorts. B. The Bureau af State Police shall pro�ide a police escort if a request is made by a permittee. A county sheriff or municipal police deparCment may refuse a permittee's request for a police escort. C. A vehicle or combination of'vehicles for which a police escart is required must be accornpanied by a state police escort when operating on the interstate highway system. 10. Taxes paid. A permit for a mobile home may not be granted �nless the applicant provides reasonable assurance that all property taxes, sewage dispasal charges and drain and sewer assessments applica6le to the rr�obile home, including t}�ose for the current tax year, have been paid or that the mobile home is exempt from those taxes. A municipality may wai�e the requirement that those taxes be paid befot•e the issuance of a permit if the �nobile hozne is to be moved from one location in the municipaIity to anather Iocatian in the same municipality foc purposes nat related to the sale of the mobile ho►�r�e. 11.
