Pursuant to 29-A MRSA � 23$2, the undersigned municipal officers of the Cify of Bangor
agree that a construction overlimit permit will be issued to the Contractor for the above-
referenced p:roject allowing the eontractor �o haul non-divisible ove:rlimit �oads on
municipal ways.
The municipa�xty may require the contracfor to obtazn a satisfactory bond pu7rsuant to
29--A MRSA § 23$$ to cover the cost of any damag� that might occur as a result o�the
overlimi� loads. If a bond is required, the exact amount of said bond �hould be determined
prior to the use of any municipal way. The Maine DOT will assist in dete:t�mining the
amount o�the bond if requested. A sugges�ed �'onnat for a general construction overlimi�
bond is attached. A sugges�ed �ormat for a construction overlim'rt permit is also a�tached.
This construction overlimit pertnit does not supersede rules that res�rict the use of public
ways, such as posting of public ways, pursuant�0 29-A MRSA § 2395.
The maximum speed �imit for trucks on any munzczpai way will b� 25 mph {40 km per
hour) unless a higher speed lxmit is specifically agreed upon, in writing, by the Municipal

SPECIAL PROVISION 105
CON�TRUCT�ON AREA
A Cnnst�`uction Ar�a located in the City of Bangor has been established by the Maine Department af
Transportation (MDOT) in accordance with provisions of 29-A § 2382 Maine Revised Statutes Annotated
{MRSA}.
(a) The section of highway under construction in the city o�Bangor, Penobscot County on.US
Route 202 ovex Interstiate 395.
(b) (US Route 2Q2} over Interstate 395 station 210+75.00 to station 218+25.00 of the
const�uction plus approaches.
Per 29�-A § 2382 (7) MRSA, the MDOT may "issue permits for stated periods of time for loads and equipment
employed on public way construction projects, Unrted States Government projects or construction of private
ways, when within const�uction areas established hy the Department of Transportation. The permit:
A. Must be procured fi•oni the municipal offzceYs for a constr�uction area within that municipality;
B. May requzre the contractar ta be responsible for damage to �vays used in the construction areas and
�nay provide for:
(.l) Withholding hy the agency contracting the work of final payrnent under contract; ar
(2) The furnishing of a bond by the contractor to guarantee suitable �epair or payment of
damages.
The suitability of Nepairs or the crmount of darrtage zs to be determined hy the Department of
Transportation on state-maintained ways and bridges, otherwise by the municipal o�cers;
C. May be granted by the Department of Transportation or by the state engineer in charge of the
constructzon contract; and
D. For const�uction aYeas, carries no fee and does not come�vithin the scope of this section. "
The Municipal Of�'icers for the City of Bangor agreed that an Overlimit Per�nit will be issued to the Contractox
for the purpose of using loads and equipment on municipal ways in excess of the Iimits as specified in 29-A
MRSA, on the municipal ways as described in the "Construction A.z�ea".
As noted above, a bond may be required by the mw�icipality, the exact amount of said bond to be determ.zned
prior to use o�any municipal way. The MDOT will assist in determining the bond amount if requested by the
rnunicipality.
The maximum speed limits for �cks on any town way will be 25 mph {40 krn per hour) unless a higher legal
limit is specifically agreed upon in wxrting by the Municipal Officers concerned.

GENERAL GU�DANCE
CONSTRUCTION 4VERLIMIT PERMIT AND SONDING
The Maine Bureau of Mator Vehicles (BMV) establishes xequirements and standards £or
the perr�itting of non-dzvisible over dimensional and overweight �ehicles and loads
(colleetively overlirr�it loads) on stafie roads. These state motor vehicle permits are
available an-line. 29-A MRSA and Secretazy oF State Administrative Rules Chapters
155-157 apply. Additionally, municipalities and county commissioners rr�ay issue
overweight pez�its for travel on municipal and county �vays maintained by �hat
municipality or county. These perrrii#s are typically single trzp permits requirir�g vehicle
registration data, intended xoute etc.
Hawever, in this case we're dealing with Construction Permits involving
overlianit loads in support of construction projects. According to 29-A MRSA § 2382
{7}, a Construction Pezmit is a permit `for a stated period of time that may be issued for
roads and equipment employed on public way construction pYojects, United States
Government p�ojects or construction of private ways, when within construction areas
established by the Department af Transportatian". According to 29-A § 2382 MRSA,
the construction averlimit perrr�it must be pracured �rom the municipal o��'icers far
overweight loads on a rnunicipal way in support of a canstruction praject within that
municipality.

Frequeutiv Asked Quesfions:
A. Wh si n the document in advance of the actual construction cont�act?
Response: There are thiree primary reasons: First, to comply with 29-A § 2382.
Second, to ensure that there are no surprises regarding the use of municipal roads by the
Maine DOT contractor (to reasonably reduce risk and thus keep the cost of construction
dow�} and third, to ens�e Y�e town is aware of its rights ta control its own roads, and 'rts
rights to require a separate contractor's bond. (This is in addition to the Payrnent Bon.d
and the Performance Bond the Maine DOT requires of the contractor).
B. Diffezent roads ma re uire different levels of scrutin . How is a osted road
handled?
Response: Despite the general construction overweight permit, the contractar
caz�ot e�ceed the load limit on a posted municipal road withaut specific municipal
permission. 29-A § 2395 MRSA notes that any ways requiring special protection (such
as posted roads) will cantinue to be �rotected and overweight permits are superseded by
such postings. In s�ch a case the contractor would have to use an alternate route.

C. Ts there anv reason why the contractar cannot be held to___indemnify az�d hold

Response: The abjecti�ve of our standard letter is to deal with overweight
equipment and trucks on z�r�unicipal ways during construction o£ a Maine DOT
construction project. The bond merely pzovides a measure of protection against damage
to mur�icipal ways as a direct result of constz-uctian activity. Other areas of �isk and
indez�z�i�ication are beyond the scope of our letter.
D. Are we required to obtain a bond?
Response: No. In fact, few xz�unzcipalities have required a construction bond. It
is a matter af risk management.
E. If used, what amount should be required on the bond?
Response: Previous MDOT letters used ta speak about a maximum bond amount
of$14,000 / znile ($9,Q001 kilometer ) of traveled length, hawever 29-A § 2382 sets no
maximum. The a�ount o� the bond (if any bond is required at all} is based on the
individual situation. The MDOT will assist in providing a bond amout�t estimate if so
requested.
F. Whv the blanket approval?
Re�s onse: The blanket appro�al we seek is the reasonable accornrnodatian by the
municipality to allow the Maine DOT contractor to use town ways (if required ) to haul
overweight construction equip�ent and trucks. This theoretically gives the municipality
and the MD4T tizne to discuss exceptians to a blanket appraval. In general, this avoids
unnecessa�y risks and saves money for all concerned in the lang run.
G. Wl�o determines the suitabili of re airs?
Response� For rz�.unzcipal ways, thE sui#ability of repai�s may b� determined by
munici�al off'icers. The MDOT will assist.
H. What is a non-di�isible.load?
Response: Per Cka�ter 157 {The Adznznistration of Over-Dimensian and
Overweight Pezmzts} under the Secretary of State adminis�trative rules {See Rule
Chapters for the Department of the Secretary of State on line), a non-divisible
load is defined as: A load which, i� separated into smaller Ioads or vehicles,
would:
�) make it unable to perform the fiinction for which it was intended;
2) destroy its value or;
3) requzre more than eight wark hours to dismantle using appxopriate
equipment. �ealed oceangoing containers, spent nuclear materials in
casks, and government-contz'olled military vehicles and �heir Ioads will be
considered non-divisible

Z. What is the standard for Overwei�ht trucks ar�d equi.pment?
Response: 4verweight means a weight that exceeds the legal Iimits established in
29-A MRSA Chapter 21.
J. This is an unor anized towzashi with no coun or znunici al roads. Wh
should I respond�
Response: Because of Iimited staff, we send out a standard Ietter ta cover
contingencies and zx�inimize risk to the construction process. From time fio time
the letter may not have a practical application. In rnost cases of unorganized
territories, the agreement is signed and returned as a matter of routine. This
ensures that surprises will not be encountered after the start of construction
regarding travel ovez'municipal and county ways.
Additional txps:
Faise Information - Permit are invalidated by false information. A permzt is invalidated
by the violation of azry candition specified by the terms of the permit ox hy false
infarmation given on the application. On evidence of such violation of falsification, the
pez�zxzittee may be denied additional permits.
Prot�er Registratzon - Overload permits do nat relieve the registrants of vehicies from
their obligations to properly register their vehicles in accordance with Motor Vehicle
Laws.
A�ent's Power of Attornev � If you do require a contractor's bond, make sure you have a
copy o�the Surety Agez�t's power of attarney authorizzz�g the sure�y agent to sign for the
surety. Keep the power of attorney with your duplicate original bond at the municipality.
The contractor will also have a duplicate original.
Other bonds - The Maine DQT requires a payment bond and a performance band of the
contractar which is held agair�st unsatisfactory perfoz�ance on the part of the cantractor
�or alI construction projects aver $10Q,040. (The Miller Act (40 U.S.C. 270a-270f}
nozmally requires performance and payment bonds for a�y federal aid constructian
coz�tract exceeding $100,000. 14 MRSA § 871 �rovides a siz�r�ilar requirement for state
funded construction projects.) These bonds caver the proper perfor�xaance of the contract
and the payment a�ali employees, suppliers and subcontractors.

OVERLIMIT PERMITS
Title 29-A 2352 MRSA Overlimit Movement Per�its.
1. Overlimit movement permifs issued by State. The Secre�ary of State, acting under
guxdelines and advice of the Comnnzssioner af Transportation, may grant permits to move
nondiviszhle objects having a length, width, height or weight greater thaa� specif ed in this
Title over a way or bridge maintained by the Departnr�ent of Transportation
2. Permit fee. The Secretary of State, with the advice of the Car�missioner of
Transportation, may set the fee for single trip pennits, at not less than $6, nox mare than
$34, based on we�ght, height, length and width. T�e Secretary of State may, b� rule,
implement fees that have been set by the Commissioner o� Transportation fox za�ultiple
trip, long-terrri overweight movement permits. Rules esta�blis�ed pursuant to this sectian
are routine technical rules pursuant ta Title 5, chapter 375, subchapter II-A.
3. County and manicipal permifs. A county cornrnissioner or rnunzczpal officer may
grant a pernr�it, �or a reasonable fee, for travel over a way or bridge maintained by that
county or municzpality
4. Permi�s for weight. A �ehicle granted a permit for excess weight must first be
registered�ar the maximum gross ve�icle weight allowed for that vehicle.
5. S�ecial mobile equipment. The Secretary of State �aay grant a permit, fox no more
than one year, to move pneumatic-tire equiprnent under its own power, including Class A
and Class B special mobile equipment, over ways and bridges maintained by the
De�artment of Transportatian. The fee far that pernnit is $IS for each 30-day period.
G. Scope of permit. A permit is �imited to the particular vehicle or object to be moved,
the trailer or semitrailer hauling the overlimit object and particular ways and bridges.
7. Construction permits. A permit for a stated pez�zod af time may be issued far loads
and equipment exxzplayed an public way construction projects, United States Gavernm�nt
projects or construction o�pri�vate ways, when within construction areas established by
th�Department of Transpartation. The permit:
A. Must be procured from the municipal off cers for a construction area within
that municipality;
B. May require the con.tractor to be responsible for da�z�age to ways used in tkae
construction areas and may provzde for:
(1) Withholding by the agency con�'acting the work of final payment
under contract; ar

S. Gz-oss vehicle weight permits. The following may grant permits to operate a vehicle
having a gross vehicle weight exceeding the prescribed limit:
A. The Secretazy o�State, with the consent of the Department of Transpoz-tation,
for state and state aid highways and bridges within czty oz compact village Iirr�rts;
B. Municipal officers, far all other ways and bridges within that city and compact
village Iimits; and
C. The county cammissioners, �or caunty roads and bridges located in
unorganized territory.
9. Pilot vehicles. The following restrictions apply to pilot veYzicles.
A. Pilat vehicles required l�y a permit rnust be equipped wzth warning lights and
signs as required by the Secretary of State wi�li the advice of the Department of
Transportation.
B. Warning lights may be operated and lettering on the signs may be visible o� a
pilot vehicle only while it zs escorting a vehicle with a pe�rznit an a�ublic way.
With the advice of the Cammissioner of Transportation and the Chief of the State Police,
the Secretary of State shall establish rules for the operatzon of pilot vehicles.
9-A. Police esca�. A person �nay not opexate a single vehicle or a corr�bination of
vehicles of 125 �eet or more in Iength or 16 feet or znoz'e in width on a public vvay uniess
the vehicle or combination af�vehicies is accompanied by a police escort. The Secretary
of State, with the advice o� the Commissioner of Transportation, may require a police
escart for vehicles of lesser diznensians.

A. The Bureau of State Police shall establish a fee for state police escorts to
defray the costs of providing a police escort. A couz�.ty sheriff or municipal police
department may estabiish a£ee to defray the costs of providing police escorts.
B. The Buz�eau of State Police shall�rovide a police escort if a request is made by
a permittee. A co�nty sheriff or munici�aal police department �nay refuse a
permittee`s request for a police escort.
C. A vehicle or combination of vehicles �or vvhich a police escort is required must
be accompanied by a state police escort when operating on the interstate highway
systerr�.
1.0. Taxes paid. A perrr�it for a mobile home may not be granted unless the applicant
provides reasonable assurance that alI property ta.xes, ser�vage dis�osal charges and drain
and sewer assessments applicable to the mobile hom.e, including those for the current tax
year, have been paid or thaf the mobile home is exempt fram thas�taxes. A rr�unicipalxty
may waive the requirement that those taxes be paid before the issuat�ce of a permit if the
mabile home is to be moved frozxx one location in the municipality to anather Iocation in
the same municipality for�urposes not related to the sale of the mobile hame.
11. Violation. A person who moves an object over the publ'zc vvay in violation of this
section comrnits a traffic infraction.
