PENOBSCOT ROOM, LOWER FLOOR OF PENQUIS CAP 262 HARLOW STREET MEETING MINUTES Board Members Present: Chair Reese Perkins Vice Chair Ted Brush (via Zoom) Michael Bazinet Jonathan Boucher (via Zoom) Trish Hayes Janet Sanborn Jonas Jennifer King (via Zoom; voting in absence of Donald Meagher) City Staff Present: Anja Collette, Planning Officer Grace Innis, Assistant Solicitor Brian Scannell, Planning Analyst Chair Perkins called the meeting to order at 7:00 P.M. PUBLIC HEARING - LAND DEVELOPMENT CODE AMENDMENTS 1. To amend the Chapter 165 of the Land Development Code of the Citv of Banqor bv removinq and/or rewordinq sections of the Code to aliqn with the State of Maine statutes for the requlation of manufactured housinq. Chair Perkins introduced the agenda item. Planning Officer Anja Collette provided an overview of the proposed amendment. Chair Perkins asked the Board for any questions or comments —there were none. Chair Perkins opened the public comments —there were none. Public comments closed. Member Jonas asked about materials for exterior siding, and whether fiber cement would be considered residential in appearance. Planning Officer Collette clarified that Code Enforcement can make this determination when reviewing permit applications and that the language provides some flexibility with interpretation. Member Jonas also asked for clarification on the need for permanent foundations to have skirting. Member Bazinet asked for further clarification regarding foundations—Chair Perkins clarified. Chair Perkins stated his satisfaction with the changes that had been made to the language since the discussion at the August meeting. Perkins also stated that he would vote yes because the changes are required by law, but expressed his opposition to being forced by the State to make a change to the ordinance that the City may not otherwise choose to make. Member Boucher moved that the Board recommend to City Council that the proposal to amend Chapter 165 of the Land Development Code by removing and/or rewording sections of the Code to align with the State of Maine statutes for the regulation of manufactured housing ought to pass. Seconded by Member Hayes. Member Bazinet asked for clarification regarding compliance with the State law—Planning Officer Collette clarified. Roll call vote conducted —five in favor, two (Chair Perkins and Member Bazinet) voted in favor but under protest of the State law. Motion passed. OTHER BUSINESS 2. Discussion on Comprehensive Plan Amendments Planning Officer Anja Collette presented the agenda item and provided an overview of the proposed amendments. Member Jonas mentioned that she and her husband are active with Bangor Beautiful and the Downtown Bangor Partnership beautification committee; was unsure if this would give her any conflict of interest with some of the amendments. Collette stated that the Comprehensive Plan by nature affects everyone in the community; therefore, it would be difficult to have a conflict of interest with the plan. Member Boucher asked for clarification around affordable housing figures — Planning Officer Collette clarified that this number just includes subsidized housing and that the information comes from Maine State Housing Authority and the Assessing Department. Chair Perkins asked about soils testing — Planning Officer Collette clarified that this is just a recommendation to test for common contaminants like lead before creating an urban garden. 3. Adoption of Notices of Decision for Ohio Street — Brian Hatch, 28 Hayes Street— Maine DVEM, and 154 Sunset Avenue — Bangor Housing Authority Vice Chair Brush moved that the Board adopt the Notices of Decision for Ohio Street— Brian Hatch, 28 Hayes Street— Maine DVEM, and 154 Sunset Avenue — Bangor Housing Authority. Seconded by Member Jonas. Roll call vote conducted —all voting members in favor, none opposed. Motion passed. 4. Adoption of Notice of Decision for Haskell Road — Brennan Development, LLC Page 2 �3 City of Bangor Planning Division Planning Board Meeting Minutes —Tuesday, September i�, 2024 Member Jonas moved that the Board adopt the Notice of Decision for Haskell Road — Brennan Development, LLC. Seconded by Member Hayes. Roll call vote conducted —all voting members in favor, none opposed. Motion passed. Chair Perkins asked if requested City Engineer's reports had been received — Planning Officer Anja Collette confirmed that they had been. 5. Meeting Minutes — September 3, 2024 Member Bazinet moved to approve the minutes of September 3, 2024, seconded by Member Jonas. All voting members in favor, none opposed. Motion passed. Chair Perkins suggested adding an agenda item in the future for recap of City Council meeting items that pertain to the Board. Planning Officer Anja Collette expressed some concern about reviewing public feedback on previously approved projects; Assistant City Solicitor Grace Innis stated that she would look into this. Member Bazinet asked if this feedback could be presented to the Board if the Board agreed not to open any discussion about it—Collette responded that it likely could. Perkins requested that Collette and Innis work together to format presentation of this information for the Board —Collette and Innis agreed. Chair Perkins brought up possible revisions to Board by-laws. Planning Officer Collette reported that staff are working on revisions which will be presented to the Board when finalized. Planning Officer Collette reported that October will be designated as Planning Month and gave an overview of proposed activities and events. Board members expressed gratitude to Chair Perkins for spending time at each meeting educating members of the public on the role of the Board. Meeting adjourned at 7:47 pm.
