Amending Chapter 165, Land Development Code, to Correct Clerical Errors in the Dimensional Controls in
Attachment 3, Schedule B.
Summary
This Ordinance will amend Chapter 165, Land Development Code, by correcting clerical errors in the
dimensional control table contained in Attachment 3, Schedule B. When the ordinance regarding multi -family
and mixed commercial residential in the S&PS and GC&S zones was adopted, the note numbers used for the
lot area and buffer requirements in the dimensional control table were overwritten in the Land Development
Code by another ordinance adopted soon after. Therefore, the current numbers in the Code do not reflect
what was adopted in the original ordinance.
Additionally, when the ordinance regarding co -living dormitories was adopted, the dimensional control table
was erroneously left off of the adopted ordinance. This change would restore the table.
In sum, this ordinance amendment would insert the dimensional controls for co -living dormitories and would
correct the dimensional controls for multi -family residential and mixed commercial residential uses in
Attachment 3, Schedule B of the Land Development Code.

ORDINANCE, Amending Chapter 165, Land Development Code, to Correct Clerical Errors in the Dimensional

WHEREAS, at present, the current numbers in Attachment 3, Schedule B do not reflect what was adopted in
the original ordinance for multi -family and mixed commercial residential uses in the S&PS and GC&S zones;
WHEREAS, when the ordinance regarding co -living dormitories was adopted, the dimensional control table
was erroneously left off of the adopted ordinance;
WHEREAS, this ordinance amendment would insert the dimensional controls for co -living dormitories and
would correct the dimensional controls for multi -family residential and mixed commercial residential uses in
Attachment 3, Schedule B of the Land Development Code;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR AS FOLLOWS, THAT
Chapter 165, Attachment 3, Schedule B of the Code of the City of Bangor is amended as shown on the
attached exhibit.

Amending Chapter 165, Land Development Code, to Correct Clerical Errors in the
Dimensional Controls in Attachment 3, Schedule B
Please accept this memorandum as the recommendation from the Planning Board for the noted item.
The Planning Board considered this item in a noticed public hearing on August 6, 2024.
The meeting was conducted in the Council Chambers at City Hall and on Zoom. Members in
attendance in the Chambers were Chair Reese Perkins, Vice Chair Ted Brush, Members Trish
Hayes, Jonathan Boucher, Don Meagher, and Mike Bazinet, and Alternate Member Janet Jonas.
Planning Officer Collette presented the proposed changes to the ordinance.

A. The purpose of this amendment is to correct clerical errors in the dimensional control
table contained in Attachment 3, Schedule B of the Land Development Code. When the
ordinance regarding multi-family and mixed commercial residential in the S&PS and
GC&S zones was adopted, the note numbers used for the lot area and buffer
requirements in the dimensional control table were overwritten in the Land Development
Code by another ordinance adopted soon after. Therefore, the current numbers in the

There were no comments from the public or the Board.
Member Meagher moved to recommend to City Council that the proposed changes ought to pass.
Member Bazinet seconded the motion. The motion passed 7:0 with all members voting in favor.
The result of the vote is that a majority of Planning Board members voted to recommend that the
proposed changes ought to pass.
