HomeMy WebLinkAbout2024-06-24 24-205 OrderCITY COUNCIL ACTION Council Meeting Date: Item No: Responsible Dept: Requested Action: Summary Committee Action Meeting Date: For: Against: City Manager City Solicitor Finance Director Map/Lot: Introduced for: Order Committee: Action: Staff Comments & Approvals Date: Item No: Assigned to Councilor: 24-205 JUNE 24,2024 EASEMENT DEED ELIZABETH HAGERMAN and LANCE LEWEY, property owners in Bangor, Maine, as Grantors, for valuable consideration the receipt of which is hereby acknowledged, grants to the CITY OF BANGOR, a municipal corporation organized and existing under and by virtue of the laws of the State of Maine, as Grantee, an easements to construct, maintain, repair, and widen the Ohio Street Bridge over Birch Stream, along with other activity reasonably accessory thereto, all within the limits of a strip of land in Bangor, Penobscot County, Maine, , which will hereinafter be referred to as the "Easement Area" and is more particularly described as follows: Permanent Bridge Easement Area A portion of land, being a portion of the land described in a deed to Elizabeth Hagerman and recorded in the Penobscot Registry of Deeds in Volume 12780, Page 337 (the "premises"), beginning at a point located on the northeasterly side of the right of way for Ohio Street and at the center of Birch Stream, thence 42.5'+ southeasterly along the Ohio Street right of way, thence northeasterly and perpendicular to the Ohio Street right of way for a distance of 20 feet, thence northwesterly and parallel to the Ohio Street right of way to a point at the center of Birch Stream, thence southwesterly along the center of Birch Stream to the point of the beginning. The total area of this easement is 892+ square feet and is depicted in Exhibit l. The purpose of this Easement is to allow for the installation,widening, inspection, grading and stormwater discharge, and maintenance of the Ohio Street Bridge over Birch Stream, and appurtenances in the Easement Area across the premises related to the structure. The Grantor agrees that the Grantee, its employees, designees or agents may, to the extent reasonably necessary, enter upon the Easement Area in order to install, inspect, repair, and maintain, and monitor the Ohio Street Bridge within the Easement Area. The Grantor further agrees that it, its successors, and assigns shall not place buildings or other structures within the Easement Area without the City of Bangor's Engineer first agreeing to said construction, but Grantor shall otherwise have full use and enjoyment of its property. The Grantor further grants the right to trim, clear, cut or remove any trees, brush or other vegetation planted or naturally growing, and to remove without payment of damages or compensation any building or structure now or hereinafter located on the Easement Area. 24-205 JUNE 24,2024 Furthermore, the Grantors agrees that the Grantee may access the easement area, to the extent reasonable, by crossing the remainder of the premises for any purpose described in this easement. The Grantee agrees that(1)any exercise of the rights herein granted to it shall be conducted in the least intrusive manner practicable,and that any excavation,installation, construction, repair, or maintenance activities pursuant to this Easement shall be done in a good and workmanlike manner under the supervision of the City Engineer and his designees; (2) after each entry upon the Easement Areas by the Grantee for the aforesaid purposes, the Grantee will promptly restore the surface of the Easement Areas as nearly as practicable to the same condition as existed prior to such entry; and (3) the Grantee shall exercise due care in the exercise of the rights granted hereunder so as to minimize the disturbance of any structures or improvements located on the Easement Areas and shall promptly repair any damage to such structures or improvements arising from the exercise of the rights granted hereunder.
