Title, Ordinance
Amending Chapter 268, Stormwater, to Require Owners of Stormwater Management Structures to Address
Deficiencies Within 60 Days as Required by the Maine Department of Environmental Protection (DEP) Municipal
Separate Storm Sewer (MS4) Permit Issued to the City
Summary
This Ordinance will amend Chapter 268, Stormwater, by specifying a time frame of 60 days for owners of
stormwater management structures to make needed repairs and submit evidence of the repairs to the City.
The City discharges stormwater in accordance with the MS4 Permit issued to it by the Maine DEP. The Permit
dated October 15, 2020 requires that owners of stormwater management structures repair deficiencies within
60 days and provide a record of the repairs to the City within 60 days. The current ordinance does not meet
this requirement as it states that the owner of the stormwater structure must take corrective actions to
address deficiencies, but does not specify a time limit as to when that action must be completed, nor does it
require a record of the deficiency and corrective action to be submitted to the City. Amending Chapter 268
will keep the City in compliance with the MS4 Permit.
