Referral: Amending Chapter 265, Solid Waste to allow for discontinuance of Waste Collection Service for Residents Who Rent an Additional Waste Container & Fail to Pay the Annual Invoice Aaron Houtari discussed the Ordinance changes. The revision included that thirty days after the original annual invoice date, if payment not made, termination of service to the additional container. If sixty days aged, will terminate service to all containers. Working with Casella to place stickers to identify for non-payment. Vote: Motion made and seconded, unanimously in favor. 2. Discussion: Roland Perry Forest Management Plan Aaron Houtari & Tracy Willette provided an update and discussion regarding updating the Forest Management Plan for the 1,500 conservation acres and 25 miles of trails. Which will become part of the City’s comprehensive plan. Vote: No Vote Necessary 3. Arctic Brook Fluvial Geomorphic Improvements - Riparian Easement John Theriault outlined the City’s proposal to complete a restoration project at Arctic Brook as part of a long-term effort to remove the Brook from the Maine Department of Environmental Protection (MDEP) list of Urban Impaired Streams. Arctic Brook has an approved Watershed Management Plan which identified fluvial geomorphic improvements as a high priority in the upper watershed. The City has been working with Haley Ward and Field Geology Services to design these improvements. Some of the improvements will be completed on private property and will require an easement. The riparian easement will have some restrictions to reduce future development impacts on the stream, and will allow for access when needed. This riparian easement was originally shown on a plan for the Whisper Drive Subdivision around 2008, but there was never a recording of the easement in deed. The property owner has been contacted and is willing to work with the City to provide this easement. Vote: Motion made and seconded, unanimously in favor. 4. Sucker Brook Fluvial Geomorphic Assessment-Hampden Agreement John Theriault outlined that Sucker Brook had been declared an Urban Impaired Stream by the Maine Department of Environmental Protection (MDEP). Sucker Brook lies within the City of Bangor and the Town of Hampden. Field Geology Services provided a proposal to complete a fluvial geomorphic assessment of the entire stream. The City of Bangor and the Town of Hampden have mutual interest in this assessment. The proposed cost of the assessment is $16,225, which will be funded equally by the City of Bangor and the Town of Hampden. Outcomes of the assessment will include information on the physical status of the stream, as well as recommendations to improve the habitat and form of the stream. These recommendations will be developed into future restoration projects on the stream in an effort to remove the stream from the list of Urban Impaired Streams. 2 This assessment is a requirement of the Permitee-Specific DEP Order section of the Municipal Separate Storm Sewer System (MS4) Permit issued by the Maine DEP to the City of Bangor. MDOT 025617.00 Broadway Heads Up Pedestrian Safety Improvement Modification #1 John Theriault outlined the Order that would authorize the City Manager to execute Modification #1, which amends the agreement between the Maine Department of Transportation and the City of Bangor executed on June 28, 2021. The amendment would increase the project cost by a total of $127,000 from the old total of $28,000 to a new total of $155,000. The federal rate of 80% increased by $101,000 from old rate of $22,400 to $124,000. The Municipality rate of 20% increased by $25,400 from the old rate of $5,600 to $31,000. Vote: Motion made and seconded, unanimously in favor. 6. MDOT 025033.01 Hammond Street Improvement 50/50 MPI Agreement John Theriault outlined the Order would authorize the City Manager to execute a Municipal Partnership Agreement with MaineDOT for WIN#025033.01, Hammond Street. The project consists of a one and a half inch mill and overlay of existing pavement on Hammond Street, beginning at the I-95 northbound on/off ramps and extending easterly 1.200 miles to the intersection of Union Street. The project would replace & reset (some) existing granite curb and ADA and drainage improvements. The project estimate is $725,000 with the State City's actual share cost of $362,500 or 50%. Vote: Motion made and seconded, unanimously in favor. 7. MDOT 025033.02 State Street Improvement 50/50 MPI Agreement John Theriault outlined the project consisting of a two inch mill and overlay of existing pavement on State Street (US Route 2), beginning at the intersection of Hogan Road and extending northerly 0.55 miles to the intersection of Young Street. The project would also include replacing existing bituminous curb with slip form concrete curb and would make drainage improvements. The project estimate is $460,000 with the City's actual share cost of $230,000 or 50%. Vote: Motion made and seconded, unanimously in favor. 8. MDOT 023112.00/023114.00 Penboscot Corridor Improvements (Not provided previous to the meeting) John Theriault noted a proposal from Thornton Tomasetti (formerly Becker Structural Engineers) submitted late afternoon to provide foundation design for the Penobscot Corridor Signal Improvements. Staff requests to waive the bid process and accept the proposal of $15,500 for foundation design. Vote: Motion made and seconded, unanimously in favor. Meeting adjourned
