HomeMy WebLinkAbout2001-06-27 Government Operations Committee Minutes GOVERNMENT OPERATIONS COMMITTEE � MINUTES ]une 27, 2001 Councilors Present: Nichi Farnham, Joe Baldacci Staff Present: Ed Barrett, Bob Farrar, ]ohn Hamer Other Present: Jeff Tuttle, Bangor Daily News With a quorum present, the Meeting was called to Order by Committee Chair Farnham at 5:05 p.m. 1. Ordinance, Amending the Code of the City of Bangor, Chapter 65, Animals, Article 1, Dog Control, by adding new § 65-5.1, Removal of Animal Waste. Assistant City Solicitor Hamer presented the revised Ordinance which expands � the current Ordinance (requiring the removal of dog feces in any City Parks) to include streets, sidewalks, esplanade, other public place or City-owned properly. As prepared, the revised Ordinance also included a requirement that dog feces be removed from private property as well. � � � Assistant City Solicitor Hamer noted that even though the revised Ordinance included private properry, the recommendation from the Legal Office was to exclude the private property reference. Legal staff generally felt that inclusion of this language would be difficult to enforce and could put the City in the middle of neighbor disputes, which otherwise could and should be handled as civil matters. Both Councilors Baldacci and Farnham agreed that the expanded language without the private properry reference was a good start and an improvement. The Councilors indicated that they were comfortable with the prohibitions in the new areas, but were reluctant to support the private property approach at this time. City Manager Barrett expressed his support for the expanded areas but not for the language involving private property. With the discussion completed, it was moved by Councilor Baldacci, seconded by Councilor Farnham, and unanimously voted to refer the Ordinance, with the deletion of Section B (private property) to the full Council at their next meeting. With no further business to come before the Committee, the meeting was adjoined at � 5:20 p.m.
