Jeffrey Hammond Neils Neilson Associate Board Members Present: Charles Heinonen Scott Westhrin City Staff Present: John Hamer PUBLIC HEARINGS Item No. 1 85 Thomas Hill Road-Jacqueline Norton To consider a variance appeal on building permit application CB99148 to construct a 28'x 40' detached garage with a 14 foot front yard setback where 20 feet is required. Action Taken: Variance appeal denied by a vote of 5 to 0. Peter Anderson did not participate in this variance appeal because of a conflict of interest. Item No.2 1009 Ohio Street- Frank Erb To consider a administrative appeal on Certificate of Occupancy application C099141, � proposing pizza take-out in the NSD. The only food service operation permitted in the NSD is a"delicatessen,"which is defined as "a store selling foods already prepared or requiring little preparation before eating." The Code Enforcement Office determined that the activity of assembling and baking pizzas does not qualify as a delicatessen. Action Taken: Administrative appeal granted by a vote of 5 to 0. Wayne Cartier did not participate in this variance appeal because of a conflict of interest. Item No.3 202 Exchange Street-Debera L. Pinette To consider a request for a Certificate of Occupancy extension pursuant to the Code of the City of Bangor, § 228-17B, Commercial Displays ofNudity. Action Taken: Tabled until June 16 meeting. Item No.4 65 State Street-Diva's Inc. To consider a request for a Certificate of Occupancy extension pursuant to the Code of the City of Bangor, § 228-17B,Commercial Displays of Nudity. Action Taken: Tabled until June 16 meeting. Item No. 5 148 French Street- DMC Lounge,Inc. To consider a request for a Certificate of Occupancy extension pursuant to the Code of the City of Bangor, § 228-17B, Commercial Displays of Nudity. . Action Taken: Tabled until June 16 meeting. The next scheduled meeting is Wednesday, June 16, 1999, at 7:00 p.m. in the Council Chambers.
