Item No. 1 65 State Street(a/k/a 148 French Street)
Diva's, Inc.,and DMC Lounge,Inc.
To consider an administrative appeal from the Code Enforcement Officer's failure to issue
Certificate of Occupancy applications C098253 and C098251 for a business offering adult
entertainment.
! Action Taken: Motion to continue matter until after December 10, requested by the City
of Bangor and opposed by the applicant,granted a vote of 5 to 0. Member Anderson did not
participate due to a conflict of interest,Associate Member Westhrin voted.
Item No.2 133 Second Street/51 Parker Street
Michael Conners
To consider an administrative appeal from the Code Enforcement Officer's determination
that the legally non-conforming use of two dwellings on one lot has terminated by
discontinuance.
Action Taken: Item settled prior to hearing. No action by the Board necessary.
Item No.3 254 Washington Street
David B. Lawler
To consider a motion for reconsideration of the Board's denial of a variance request at the
October 1998 meeting to reduce the parking setback to ten feet.
Action Taken: Motion to reconsider the application granted by a vote of 4 to 1. Motion
to permit applicant to amend application to include administrative appeal, alleging that the
Code Enforcement Office erred in its determination that the property had lost its
grandfathered parking, granted by a vote of 5 to 0. Motion to grant the administrative
appeal granted by a vote of 5 to 0. Member Cartier did not participate due to a conflict of
interest,Associate Member Westhrin voted.

� Item No.4 254 Washington Street

To consider a request for a hardship variance appeal from the Code Enforcement Officer's
denial of Certificate of Occupancy application C098445 for retail sales to reduce the
parking setback by five feet and eliminate the bufferyard requirements. The application was
denied because the site does not have the requisite amount of parking for a retail
establishment.
Action Taken: Application withdrawn by applicant as moot following the granting of the
administrative appeal.
Item No. 5 82 Palm Street

To consider an administrative appeal from the Code Enforcement Officer's failure to require
the removal of a carport awning because it does not meet the minimum setback requirement
for a structure.
Action Taken: Administrative appeal granted by a vote of 5 to 0.
The next scheduled meeting is Wednesday, December 9, 1998, at 7:00 p.m. in the Council
Chambers.
