Minutes Board Members Present: Peter Anderson Wayne C;artier Jeffrey Hammond Neils Neilson Associate Board Members Present: Charles Heinonen City Staff Present: John Hamer PUBLIC HEARINGS ' Item No. 1 8 Fairmount Park East Ronald St. Pierre To consider a request for a practical difficulty variance appeal from the Code Enforcement Office's denial of Building Permit application CB98475 to tear down a garage and construct a new c�ne. The application was denied because the structure was legally non-conforming and legally non-co�iforming structures lose their non-conforming status upon demolition and the proposed replacement structure does not meet the five-foot minimum setback requirement. Action Taken: Practical difficulty variance granted by a vote of 5 to 0. Item No.2 254 Washington Street David B.Lawler To consider a request for a hardship variance appeal from the Code Enforcement Office's denial of � Certificate of Occupancy application C098445 for retail sales. The application was denied because the site does not have the requisite amount of parking for a retail establishment. Action Taken: Member Cartier abstained from this application because he had recently considered purchasing the subject property. Motion to grant a hardship variance to reduce the parking setback from 20 feet to 10 feet denied by a vote of 3 to 0,with one member(Hammond)abstaining. Item No.3 27 Bellevue Avenue Nancy Torreson&Jay McCloskey To consider a request for a practical difficulty variance appeal from the Code Enforcement Office's denial of Building Permit application CB98522 to tear down a garage and construct a new one. The application was denied because the structure was legally non-conforming and legally non-co�iforming structures lose their non-conforming status upon demolition and the proposed replacement structure does not meet the five-foot minimum setback requirement. Action Taken: Practical difficulty variance granted by a vote of 5 to 0. Item No.4 635 State Street Eastern Maine Healthcare To consider a request for a variance under the Floodplain Management Code to permit the Code Enforcement Office to issue a Flood Hazard Permit, FH98004, for renovations to the Waterworks complex. The Flood Hazard Permit was denied because the proposed lowest floor elevation is not one foot above the 100 year flood elevation. . Action Taken: Member Anderson abstained from this application because his wife is employed by Eastern Maine Healthcare. Floodplain Management variance granted by a vote of 4 to 0. The next scheduled meeting is Wednesday,November 18, 1998, at 7:00 p.m. in the Council Chambers.
