CITYOFBANGOR JOHN THERIAL)IT PE, PTOE CITY ENGMER To: Infrastructure Committee From: Engineering Department, John Theriault Date: January 4, 20,23 Re: Discontinuance of a Portion of Hildreth Street Dear Councilors, The Community and Economic Development Department have been contacted by J.B. Brown & Sons with a request for the City of Bangor to discontinue a portion of Hildreth Street that abuts their property. Hildreth Street, which is located on the south side off of Outer Hammond Street, was originally accepted by the Bangor City Council on January 23, 1946. The, cuirrent developed portion of Hildreth Street includes an 80 foot wide right of way and has a length of 2,000 feet, The portion of right of way requested to be discontinued lies south of the developed portion of roadway and is depicted in, a layout plan developed by the Bangor Real Estate Development Co. and approved by City Council in 1951. This section of right of way has a width of 40 feet for its first 250 feet and then increases to 80 feet for an aipproximate length of 625 feet. This portion of Hildreth Street right of way terminates at the existing railroad right of way. This portion of right of way has yet to be improved and the City has no current plans for constructing this segment of roadway. Much of the stormwater from the Hildreth Street development drains to this southerly portion of right of way via an 18" reinforced' concrete pipe (RCP). The Engineering Department recommends that should this portion of right of way be discontinued, the City maintain a twenty foot wide stormwater easement centered on the existing drainage pipe for future maintenance. In order to discontinue a public right of way, the city must complete the, process in accordance with 23 M.R.S.A. § 3026-A which includes notification to abutters, posting notice, publiic meeting, and the preparation of a report of findings by the City Engineer. 73 HARLOW STREET BANGOR, ME 04401 TELEPHONE: (207) 992-4250 FAX: (207) 992-4194 WWW.BANGORMAINE.GOV Because the City has no future plans to construct an extension to Mildreth Street and where both sides of this right of way is owned by a single property owner, the Engineering Department recommends that the Bangor Council authorize the City Engineer to initiate the process to discontinue a portion of the Mildreth Street right of way as depicted in Exhibit A that accompanies this memo.
