HomeMy WebLinkAbout2022-10-24 22-362 OrderCITY COUNCIL ACTION Council Meeting Date: 10/24/2022 Item No: 22-362 Responsible Dept: Code Enforcement Requested Action: Order Map/Lot: 053-023 Title, Order Authorizing the City Manager to have the Detached Garage at 115 Parkview Avenue Demolished and to Lien the Property in the Amount of Demolition and Disposal Costs Summary This Order would authorize City staff to take action and expend funds to demolish the dilapidated garage at 115 Parkview Avenue and lien the property for the costs incurred. The garage at 115 Parkview Avenue first became an issue in August, 2016, when an investigation of a complaint found the garage to be in disrepair, with walls leaning and sagging and roof shingles failing. A Notice of Violation was issued on August 23, 2016, with repair or demolition given as options to abate the violations. On April 2, 2022, a City of Bangor Building Inspector viewed the property after a complaint. The original violations had not been abated, and the structure was found to be more deteriorated and dangerous. An additional Notice of Violation was issued on April 5, 2022. From April, 2022 until September, 2022 Code Enforcement attempted to work with the owner of the property to encourage demolition and secure potential funding for demolition at no cost to the owner. Code Enforcement was not successful in obtaining the owner's permission for demolition. A notice requiring progress toward repair or demolition was sent to the property owner and posted on the property on September 7, 2022. On October 13, 2022, a second notice of demolition was posted on the structure and mailed to the owner via certified mail. To date, no progress has been made in obtaining a permit for repairs or demolition. The structure is unsafe, a blight on the surrounding neighborhood, and is leaning on the garage of the abutting property. City Manager Introduced for: New Business Meeting Date: 10/24/2022 For: Against: C��Za - City Solicitor Finance Director CITY OF BANGOR ORDER Date: 10/24/2022 Item No: 22-362 Assigned to Councilor: Sprague Authorizing the City Manager to have the Detached Garage at 115 Parkview Avenue Demolished and to Lien the Property in the Amount of Demolition and Disposal Costs WHEREAS, the property located at 115 Parkview Avenue (Map -Lot 053-023) has been in violation of the City's Property Maintenance Code since 2016; and WHEREAS, the garage has further deteriorated since 2016; and WHEREAS, the garage is currently leaning on the garage of the abutting property; and WHEREAS, attempts of resolution by Code Enforcement with the owner of the property have not been successful; and WHEREAS, the building is currently an unsafe structure due lack of a proper roof, structural damage, and leaning/sagging walls; and WHEREAS, On September 7, 2022, a demolition notice was posted on the structure and mailed to the owner via certified mail; and WHEREAS, on October 13, 2022, a second notice of demolition was posted on the structure and mailed to the owner via certified mail; and WHEREAS, needed repairs have not been performed as of the date of this Order; Be it Ordered by the City Council of the City of Bangor that, The City Manager is hereby authorized to take action and expend funds to demolish the dilapidated, detached garage at 115 Parkview Avenue and lien the property for the costs incurred. ...................... ... .. .... . Stephen Wagner was in favor of demolition. Motion made and seconded to Close Public Hearing Public Hearing Closed Motion made and seconded for Passage Motion to amend to use abatement money or other funds so owner does not have to bear the cost.
