These changes will facilitate the expansion of EV charging equipment and are considered appropriate to the relatively small size of this equipment. If buffering is required for the lot in question where the EV charging stations are proposed, the buffering around the chargers may be eliminated within 5 feet in any direction of the equipment. Committee Action Committee: Planning Board Action: Staff Comments & Approvals Meeting Date: October 18, 2022 For: Against: J/- City Manager City Solicitor Finance Director Introduced for: First Reading and Referral 22-347 10/12/2022 CITY COUNCIL ORDINANCE Date: October 12, 2022 Assigned to Councilor: Sprague ORDINANCE, Amending Chapter 165, Land Development Code, by defining EV charging stations and exempting them from parking setbacks WHEREAS, at present, electric vehicle charging stations would not be allowed within parking setbacks, WHEREAS, the small size of electric vehicle charging stations minimizes detrimental effects on surrounding properties, making it feasible for them to be located within parking setbacks; WHEREAS, it is a goal of the City to reduce greenhouse gas emissions and allowing for increased accessibility to electric vehicle charging stations can assist with reducing transportation emissions in the City; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR AS FOLLOWS, THAT Chapter 165 of the Code of the City of Bangor is amended as follows: § 165-13 Definitions ELECTRIC VEHICLE (EV) SUPPLY EQUIPMENT Equipment used for supplying power to electric vehicles (EV's) § 165-73 Parking area location and screening. C. Electric vehicle (EV) supply equipment are exempt from setback requirements and therefore may be located in the parking setbacks listed in §165-73.B above. EV supply equipment do not require a land development permit, but must meet National Electrical Code standards. If buffering and/or screening is required for the lot in question where the EV supply equipment is proposed, the buffering/screening may be eliminated within 5 feet in any direction of the equipment. The change also defines EV Supply Equipment. Please accept this memorandum as the recommendation from the Planning Board for the noted item. The Planning Board considered this item in a posted public hearing on October 18, 2022. The meeting was conducted in the Council Chambers at City Hall and on Zoom. Members in attendance in the Chambers were the Chair, Ken Huhn, and Members Don Meagher, Ted Brush, Reese Perkins, Mike Bazinet, and Trish Hayes. This was a staff-led Code change request. Planning Officer Krieg presented the proposed changes. From the staff memo: A. This amendment provides relief from the setback requirements for parking lots. B. The reason for this change is to encourage the placement of EV charging equipment. Under current regulations, these apparatus would have to hold the parking setback. There were no questions from the public. The Board discussed possible life safety code needs for bollards. Member Perkins made a motion to recommend to the City Council that the noted text amendment ought to pass. Member Bazinet seconded the motion.
