Summary Jordan Chapman of Michigan seeks to change a 20,000 SF lot at 685 Broadway from the GC&S district to the S&PS district. The purpose of this request is to take advantage of lessened dimensional requirements for this district as to setback. These setbacks would be in keeping with other properties in this part of the Broadway Corridor. The previous contract would be nullified with this action. The previous contract was to accommodate automotive sales. WHEREAS, at present, most of the Broadway Corridor near the I-95 interchange is S&PS; WHEREAS, at present, there is a planned reuse of a property that is zoned GC&S; WHEREAS, at present, the redevelopment of the lot would be best served by S&PS; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR AS FOLLOWS, THAT Chapter 165 of the Code of the City of Bangor Zoning District Map is hereby amended as follows: The property addressed at 685 Broadway is hereby rezoned from General Commercial & Service District (GC&S) (contract zone) to Shopping & Personal Service District (S&PS). The Planning Board considered this item in a noticed public hearing on July 6, 2022. The meeting was conducted in the Council Chambers at City Hall and on Zoom. Members in attendance in the Chambers were the Chair, Ken Huhn, and Members Don Meagher, Ted Brush, Reece Perkins, Lisa Shaw, and Mike Bazinet. The applicant, Jordan Chapman, reviewed the request for the Board. There were no questions from the public. From the staff report: A. The applicant seeks to change the property located at 685 Broadway from a General Commercial & Service District (GC&S) contract zone to the Shopping & Personal Services District (S&PS). The current contract conditions on the property stipulate that it must remain a vehicle display lot; the applicant wishes to remove these conditions and change the zone to allow for their potential development on this property and the adjacent property at 699 Broadway. B. The current zoning surrounding this property is S&PS and this area is shown as S&PS in the 2012 Comprehensive Plan. Board members were pleased to approve a zoning change to bring a property in compliance with the Comprehensive Plan. Member Brush made a motion to recommend to the City Council that the application for a district change ought to pass. Member Perkins seconded the motion. Our immediate recommendation is to'ensure that the building is temporarily stabilized, Mark where foundation walls) are to be constructed (under all bearing wills, exterior and interior). This area must be cleared and leveled in preparation of installing a new footing and foundation wall. Select the desire , epth of the basement and. establish this elevation°, clear an area -o' wide approximately one foot deeper (to account for footing thickness). Use 3f ". clean crushed stone: to level this area or perimeter path. Install forms for footing. The footing shall be 12" x " minimum with (S) ##4 bars running continuously around the perimeter. The footing should have a shear key formed. This can easily be accomplished with embedment of a 2x4. This may require sortie sill or beam replacements. These internal members will require. internal columns and footings. Once the foundation has properly cured, the building can be carefully set dawn and secured. The building sill must be secured to the top of the concrete wall. The contractor may utilize one of the following options. Install 1/2" embedded (ds') epoxy anchors at 4on-center and each corner and at each side of each opening. 'Another option allows for the use of a Simpson tie down equal to LSTA 18 at 2' on -cent r. This product requires 14- 10d,fasteners. Other products are available from Simpson thatmay provide the hold.down force needed. As long as the #4L bars installed in the footing, at 12"o.c., extends far enough to engage the lowest wall horizontal rebar, measured from the footing, the current configuration will be accep ble. Again the #4L bars at 12"o.c. cast in the footing extending into the wall, will take the required sheer load needed. Therefore; the cast in keyway is not required in this case. `these clarifications are meant only to revise allowable placement of the first horizontal rebar, and the elimination of the cast in sheer key.
