Summary
Zachary Gilpin, of Hampden, Maine, seeks to change the property at 85 Walter Street from URD-1 to URD-2.
The buildout under the dimensional requirements would be 4 units as a URD-2. There are two adjacent
properties zoned URD-2.
The Comprehensive Plan indicates this property as low -density residential. The property is contained in the
growth area. The City Council seeks to create units where reasonable and feasible and often utilizes the
recommendations in the 2019 Recommendations from the Affordable Housing Work Group.

ORDINANCE, Amending Chapter 165, Land Development Code, District Map, by changing the Parcel of Land
addressed at 85 Walter Street from Urban Residence 1 (URD-1) to Urban Residence 2 (URD-2).
WHEREAS, at present, there is a need for more dwelling units near transportation, goods and services;
WHEREAS, the City Council seeks to provide units where reasonable and feasible;
WHEREAS, there are other lots in the area of the subject property that are zoned URD-2;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR AS FOLLOWS, THAT
Chapter 165 of the Code of the City of Bangor is amended as follows:
The Zoning District Map is hereby amended by changing the Parcel of Land addressed at 85 Walter Street
from Urban Residence 1 (URD-1) to Urban Residence 2 (URD-2).

Zone Change – 85 Walter Street – Map-Lot 035-005 - Urban Residence District 1 (URD-1) to
Urban Residence District 2 (URD-2)
Please accept this memorandum as the recommendation from the Planning Board for the noted item. The
Planning Board considered this item in a noticed public hearing on June 7, 2021.
The meeting was conducted in the Council Chambers at City Hall and on Zoom. Members in attendance in the
Chambers were the Chair, Ken Huhn, and Members Reece Perkins and Ted Brush. Members Lisa Shaw, Don
Meagher, and Mike Bazinet attended by Zoom.
The applicant, Zachary Gilpin of Hampden presented the application. He wishes to keep the building as a two-
family.
Member Perkins indicated he feels that the proposal is spot zoning. He does not feel it is in keeping with the
current Comprehensive Plan.
The Chair noted an email received regarding the application.
Member Meagher noted that the property has been vacant long enough that it may have lost its non-
conforming status. This change would make it conform to zoning.
Planning Officer Krieg noted that it is good practice to make properties conform to zoning so improvements can
be made to properties and if it makes sense. She indicated the Affordable Housing Work Group Plan is timely
and current, thus the Board could use the recommendations as a basis to allow zoning changes for housing.
She added it is a difficult time to do zoning changes during a comprehensive plan process.
Member Shaw made a motion to recommend to the City Council that the application for a district change ought
to pass. Member Bazinet seconded the motion. The motion passed 5:1 with Members Perkins dissenting for
the reasons noted above.
