The property at 130 Thirteenth Street is currently zoned URD-1. The Comprehensive Plan indicates this property as institutional because the use is institutional. This adjacent property in total, located at 96 Thirteenth Street, owned by Penobscot Foundation for Developmental Services, sold a 4,000 + square footage piece of land to the applicants in August 2021. The applicant seeks to combine the properties to use the property as one lot in the URD-1 zone. WHEREAS, at present, a portion of land previously owned by Penobscot Foundation for Developmental Services was conveyed to the owner of 130 Thirteenth Street; WHEREAS, the applicant seeks to combine said lots and use the property in the confines and allowances of the URD-1 zoning district; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR AS FOLLOWS, THAT Chapter 165 of the Code of the City of Bangor is amended as follows: The Zoning District Map is hereby amended by changing an unaddressed 4,110 SF portion of the Parcel of Land directly adjacent to land addressed at 130 Thirteenth Street from Government & Institutional Service District (G&ISD) to Urban Residence 1 (URD-1.) The Planning Board considered this item in a noticed public hearing on May 3, 2022. The meeting was conducted in the Council Chambers at City Hall and on Zoom. Members in attendance in the Chambers were the Chair, Ken Huhn, and Members Don Meagher and Ted Brush. Attending virtually were Members Reece Perkins, Lisa Shaw, Mike Bazinet, and Alison Coladarci. The applicant, Larry Dearborn, presented the application. They purchased a portion of the adjacent lot to bring the property into compliance with setbacks as well as to provide more land area. Member Brush asked for clarification on the apartment over the garage as proposed. The applicant indicated they plan to place an in-law apartment. Planning Officer Krieg confirmed that this was allowed in the ordinance. There were no questions from the public. Member Shaw indicated she supported the application because it is in keeping with the purpose of the district. Member Meagher made a motion to recommend to the City Council that the application for a district change ought to pass. Member Brush seconded the motion.
