Summary Grace Encountered (noted as a 501c3 in the application) is requesting a change of the zoning for 1456 Union Street from the Rural Residence & Agriculture (RR&A) district to the Government & Institutional Service District (G&ISD). The purpose is to use the property for the work of their non-profit. The work of non-profit agencies is an allowed use in the proposed district. The Comprehensive Plan indicates this property designated as low -density residential. The property is contained in the growth area. It is not known how this part of the city will be viewed for growth and development in the Comprehensive Plan currently in process. The use of the G&ISD is to cover those properties serving the public. The purpose of this district is described as follows: The Government and Institutional Service District is established to preserve and protect those areas of the City occupied by public and nonprofit institutional buildings or uses. WHEREAS, at present, there is a district called Government & Institutional Service District (G&ISD), which was created to allow and regulate uses that serve the needs of the public; WHEREAS, the applicant seeks to provide non-profit services to the public at the subject location; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR AS FOLLOWS, THAT Chapter 165 of the Code of the City of Bangor is amended as follows: The Zoning District Map is hereby amended by changing the Parcel of Land addressed at 1456 Union Street from Rural Residence & Agriculture (RR&A) to the Government & Institutional Service District (G&ISD). The Planning Board considered this item in a noticed public hearing on April 19, 2022. The meeting was conducted in the Council Chambers at City Hall. Members in attendance were the Chair, Ken Huhn, and Members Reece Perkins, Don Meagher, and Ted Brush. Members Mike Bazinet, Lisa Shaw, and Alison Coladarci attended by Zoom. The applicant, Larry Dearborn from Grace Encountered, presented the application. He indicated the property would be developed to help people in transition. The proposed land use would be a mixed- use service development. The Board spent deliberation time regarding the methods of assigning the G&ISD to a parcel. Planning Officer Krieg cautioned the Board to not make a decision on this assignment based on the proposal at hand. Though it’s useful to know what type of development may go into a site as part of a zoning application, the applicant is not held bound by that proposal. The Board should assume any use allowed in G&IS may be proposed in the future at that location. She added the following from the Planning Staff Memo: G&ISD is an unusual zone in the work of districting a community. The Land Use Plan outlined areas that were already in government or institutional use at the time of the preparation of that plan. The district itself is meant to be assigned where such facilities exist; thus, it's not an area or a district that is customary in zoning practice. This makes the new assignment of G&ISD a little more challenging. The Board is tasked with answering the question: is this a good location for institutional uses. As typical, the Board is cautioned to not be solely guided by the proposal in the application; but by the assignment of the district in this location. Member Shaw, however, did recognize the need for additional housing for people in transition. Member Brush felt the proposal had too many uses proposed for the lot. Member Perkins expressed concerns about traffic from the possible uses on that portion of Union Street. Member Shaw made a motion, with a second from Member Perkins, to recommend to the City Council that the zone change ought to pass.
