Summary Lynna Tupica of 64 West Street seeks to change the zoning for their property from Urban Residence 1 district to the Urban Residence 2 District. The property was noted as low -density residential. The neighborhood is zoned URD-1. The Council has been dedicated to allowing for more units where reasonable and feasible for the last few years and passed a policy to this effect. The 2019 recommendations from the accepted Affordable Housing Work Group also indicate the City should seek to create housing units where possible. The Planning Board considered this item in a noticed public hearing on April 19, 2022. The meeting was conducted in the Council Chambers at City Hall. Members in attendance were the Chair, Ken Huhn, and Members Reece Perkins, Don Meagher, and Ted Brush. Members Mike Bazinet, Lisa Shaw, and Alison Coladarci attended by Zoom. The applicant, Lynna Tupica, presented the application. She indicated the zoning change would bring the property into compliance. She added there were other two-family residences in the area. Member Perkin indicated he feels strongly this is spot zoning. The uses may be non-conforming in the area but the zoning is all URD-1. He added his reading of the Affordable Housing Work Group did not intend the city to rezone lot by lot. He thinks the city should overhaul the zoning in these neighborhoods to be URD-2. The Chair responded that the city needs more units. Adding URD-2 as requested now helps until the Comprehensive Plan is finished and the zoning is re-written which takes time. Member Shaw added that URD-2 is consistent with the uses in the area. She doesn’t see the proposal as a radical change from the uses in the neighborhood so it isn’t spot zoning. Member Meagher made a motion, with a second from Member Shaw, to recommend to the City Council that the zone change ought to pass.
