By the pry Coumcil of the City ofBanyor: ORDERED, THATWHERE.AS, the Maine State Highway Commission proposes to relocate HIS Route 1-A from Ravpden to the Interstate Spur In Bangor, and WHEREAS, the City of Bangor has been requested to perform certain responsibilities in connection with this relocation, NOW, THERTRARE, BE IT ORDER® that the City Manager be and is hereby authorized to enter into an agreement with the State highway Comdasion to perform these responsibilities. P ASS ED Introduced and (filed by N unci man AGREENE NT THIS AGRZEMENf entered into this day of in the year of our Lord One Thousand nine hundred and sixty-four a and BETWEEN the State of Maine. through its State Highway Commission, duly authorized bw the State of Maine, hereinafter referred to as 'the State', and the City of Banger, Penobscot County, a body corporate, by and through its City Manager, thereunto duly authorized, hereinafter referred to as 'the City': WHEREAS 'the State' is planning the construction of a new location of State Highway 26 (U. S. Route lA), including an interchange with State Highway 395, together with an overpass structure over Parry Road, so-called, all In the City of Sangor, to h, known as Federal Aid Project 0.026-2(8). NOW, THERSFM, 'the State' agrees to do and perform the following: (A) To let a contract for 'the Project', to perform all of the construction requires for said 'Project', and to maintain said 'Project' upon completion, 'the Project' to include an Interchange at the so-called Industrial Spur connecting the new location of U. S. Route IA with State Highway I-395. (B) To construct the Perry Road structure carrying relocated U. S. Route LA over Perry Road. (C) To pave the baokslopes from Perry Road as constructed by the City oL Bangor lying underneath and adjacent to the overpass structure, without expense to the City of Bangor. (D) That for the construction of the overpass structure no bridge piles will he driven, supports placed, or other construction performed within 16 feet either northerly e_ southerly of the sewer new existing within the limits of Perry Road. (E) To fence the right of way acquired from or donated by the City of Bangor and others for the ramps of the interchange northerly of the Industrial Spur. AND 'the City' of Bangor agrees to do and perform the following: (A) To dead to the State of Maine that portion of the necessary right of way for the ramps of the interchange with the Industrial Spur which lies northerly of the Industrial Spur, to which it has title, including the former location of Thatcher Street, said right of way to be as shown on the right of way maps for State Higinray 26, Bangor, Federal Aid Project U-026-2(8), S.H.C. File No. 1e-156, and also as shown on the attached plan, at a scale of one inch equals 200 feet, and more specifically descrihei as follows: Beginning at a point in the northerly right of way lire of State Highway 395, which is on a line at right angles to the forward tangent of the base line of the industrial Spur, so-called, said point also being on a line at right angles to the base line of Ramp C at P.T. Station 238+19.44 Ramp c equals Station 136+91.50 industrial Spur; _ Thence westerly along the northerly right of way line ^f State Highway 395 about 900 feet to the southeasterly corner of land new or formerly of Iydia A. Cosens; Thence northwesterly along the southeasterly lira of land now or formerly of said Godsoe about 728 feat to a point which is 113 feat northwesterly from and as _2_ Boned along a line normal to the base line of Ramp C at about station 220+47, said point also being 75 feet northwesterly of the pavement edge of Ramp C before - mentioned. Thence northeasterly by aeurved line 113 feet northwesterly from and concentric with the base line of Ramp D about 95 feet to a point an a lira normal to the base line of Ramp D at P.C.C. station 221+28.65; Thence easterly along a curved line 113 feet northerly from arcl concentric with the base line of Ramp D 578.93 feet to a point on a line normal to the base line of Ramp D at Station 225+49.08, said point also being 75 feat northerly a the base line of RamP C; Thence south 59041'54" E. parallel with the base line of Ramp C 516.54 feet to a point on a line at right angles to the base line of Ramp C at P.C. Station 230±65.62; Thence easterly along a curved line 75 feet northerly from and comentria with the base line of Ramp C 706.71 feat to a point on a line at right angles to the base line of Ramp C at P.T. Station 238+19.44; Thence southerly along said right angle line about five feat to the point of beginning. The above described lot or Boreal a land contains approximately 10.84 aeras. Also an easement for highway purposes over and across Perry Road, so-called, with+ the following described beunderiee: Beginning at a Point in the southerly line of Perry Road which Is one hundred thirty (130) feet westerly from and as meeaurei along a line at right angles to the Base Line of state Highway "26" at about Station 203+84; Thence N. 11020114" E. about eighty two (82) feet to a point in the northerly line of Perry Road which is ora hundred thirty (130) feet westerly from and as measured along a Sine at right angles to the Base Lina of State Highway 1126" at about station 204+66; Thence easterly along the northerly line a Perry Read about two hundred ninety -ane (291) feet to a Point which is seventy-five (75) feat easterly from are as smeared along a line normal to the 'Ramp A" Base Line at about station 205+94; Thence southerly along a line seventy-five (75) feet easterly from and concentric with the 'Ramp An Base Line about ninety (90) feet to a point in the southerly line a Parry Bead which is on a line normal to the "Ramp A" Base Line at about Station 204+98; Thence westerly along the southerly lire of Perry Road about two hundred seventy (270) feet to the point of beginning. The two parcels of lard above described being as shown on a Right of Way Hep, State Highway "26", Hampden -Bangor, Federal Aid Project U-026-2(8), S.H.C. File No. 10-156, on fila in the office of the State Highway Commission and to be recorded 1n the Registry of Deeds of Penobscot County. The consideration for the conveyance of this lard to be $1.00 3- t (B) To permit the State Highway Commission to drain the proposed structure at Perry Road and other drainage necessary in the vicinity of Perry Road into the drainage system for Perry Road. (C) To design and construct Perry Road, including drainage, a 30 foot wide roadway cross action between curbs and a flat section five feet back of each curb. To Ueda the backelope on a 1 3/4 to 1 slope (I the State' to pave these slopes in the vicinity of the structure over Perry Road as previously noted under 'the State' agreed). (D) To permit Ithe State' to drain additional water from the Industrial Spur to and Into the Darkerville Trunk Sewer to the extent of such additional drainage as may be created by the construction of the ramps of the interchange with State Highway I-395. (E) To release the State from any responsibility for any damage to the sewer in Perry Road as a result of any construction in the vicinity of Perry Head which is carried on at a distance of more than 16 feet northerly and/or southerly of said sever. (F) To pay the costs for the construction of Perry Road. (0) To assume the responsibility for any additional cost of the proposed municipal golf course which becomes necessary as a result of the proposed interchange with the Industrial Spur as shown on the attached map and the official right of way and construction plans as prepared by the State Highway Commdeeion. (H) That no connections or interchange betweer relocated U. S. Route 1A and Perry Road will be constructed as a part of this (Project', and no present plans are contemplated for requesting such connections or interchange in the future.
