Coupal, Jr. City Manager Date September 21, 1964 Memo To: Nicholas P. Brountas, Memo No: Just to make sure there is no confusion as to the agreements reached last Friday afternoon relative to the Hogan Road Sewer, let me set forth my understanding of the arrangements as presently agreed to. 1. In a meeting with Judge Murray and Mr. Davis, a final offer was made by Judge Murray to give to the City of Bangor a deed to the necessary property running from Hogan Road to the Penlalawoc Stream to construct a sewer line, an access road, a power line and a sewage treatment plant, all in accordance with plana prepared by the Engineering Department. 2. The agreed upon price was $1,650 for said deed. 3. In a subsequent conversation with Galen Cole and Paul Rudman, the City's position was put forth that the City Engineer felt that the actual value of that property was $700 but that the Council Chairman and the City Manager felt It was possible if we were to go to court,the City might have to spend as much as $1,000 before we got through. 4. Inasmuch as the original agreement was that Cole and the City of {angor would split all costa of this Installation, the City was prepared m spend up to $500 for the acqulsltlon of this property; but that was the maximum Inasmuch as it was felt this was the most the City would have to pay if It went to court. 5. Mr. Cole,ln recognition of the fact that he might be delayed In the construction of his sewer by action taken by Mr. Davis H the City proceeded with an eminent domain proceeding, agreed that he would put in the additional $650 himself 1n order to eliminate any delay. It was finally arranged that the City Engineer should get a proper deed and submit an Order for the Council meeting on September 28 accepting said deed and amend his report to provide that we would proceed to make the installation on property that would then be owned by the City of Bangor and that all costs,other than the excess $650, of the price of the land would be assessed 50 percent to Cole and 50 percent to the City.
